TOWN OF TRUCKEE <br /> California <br /> <br />RESOLUTION NO. 98-03 <br /> <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br />APPROVING A MITIGATED NEGATIVE DECLARATION <br /> FOR THE WESTERN UNDER CROSSING PROJECT <br /> <br /> WI-IEREAS, the Town prepared an Initial Study pursuant to the California Environmental Quality <br />Act, identifying the significant environmental effects of the Western Under Crossing project and the <br />mitigation measures necessary to eliminate or reduce the significant effects to a less-than-significant level; <br />and <br /> <br /> WHEREAS, a Mitigated Negative Declaration was proposed for the project based on the findings <br />of the Initial Study; and <br /> <br /> WHEREAS, notice was provided to the public by publication in the Sierra Sun, a local newspaper <br />of general cimulation, that the Town Council proposed to adopt a Negative Declaration, and a public review <br />period of 32 days was established January 2, 1998 to February 5, 1998 for the Town to receive written <br />comments on the proposed Negative Declaration; and <br /> <br /> WHEREAS, the Town Council considered all public comments received during the public review <br />process prior to approving the Negative Declaration, and agrees to extend the left-mm lane to include the <br />intersection of Foxmead Lane and West River Street; and <br /> <br /> WHEREAS, the Town Council finds the project is subject to the Department of Fish and Game <br />filing fee for a Negative Declaration. <br /> <br /> NOW THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF <br />TRUCKEE, AS FOLLOWS: <br /> <br /> SECTION 1. The Negative Declaration (on file in the Office of the Town Clerk) is hereby <br />approved for the Western Under Crossing Project. The following f'mding is nmde in approving the Negative <br />Declaration: <br /> <br />The Initial Study identified several potentially significant effects. However, revisions were made <br />to the project prior to the release of the Negative Declaration for public review which would avoid <br />the effects or mitigate the effects to a point where clearly no significant effects would occur. No <br />revisions have been made to the Negative Declaration subsequent to the public review period, and <br />there is no substantial evidence that the project as revised may have a significant effect on the <br />environment. This finding is further supported by the findings contained within the Initial Study. <br /> <br /> SECTION 2. The Mitigation Monitoring and Reporting Program (on file in the Office of the Town <br />Clerk) is hereby adopted pursuant to Section 21081.6 of the California Environmental Quality Act. <br /> <br /> <br />
