TOWN OF TRUCKEE <br /> California <br /> <br />RESOLUTION No. 98-15 <br /> <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br />ESTABLISHING PROCEDURES FOR THE PROCESSING OF LAND USE <br />DEVELOPMENT APPLICATIONS ALONG THE HIGHWAY 267 CORRIDOR <br /> <br /> WHEREAS, Land Use Policy 3.5 of the General Plan prohibits new discretionary development <br />along the Highway 267 corridor that would result in a net increase in traffic at Highway 267 and <br />Commercial Row until the Highway 267 Bypass or other major transportation improvements are in place; <br />and <br /> <br /> WHEREAS, the factors and the assumptions based on those factors that led to the implementation <br />of Land Use Policy 3.5 have changed substantially since the adoption of the General Plan in February 1996, <br />including significant improvement in public transportation; and <br /> <br /> WHEREAS, the Western Undererossing and Highway 267/Palisades Drive traffic signalization <br />projects should be completed by October 1998, and these projects will substantially improve traffic in the <br />Downtown area to acceptable levels; and <br /> <br /> WHEREAS, the Highway 267 Bypass is fully funded and scheduled for construction in May 1999 <br />and completion in October 2001; and <br /> <br /> WHEREAS, the Council wishes to eliminate restrictions imposed by Land Use Policy 3.5 on the <br />processing of land use development applications and the issuance of construction permits for properties <br />along the Highway 267 corridor, thereby allowing development to occur once the Western Undercrossing <br />is completed and construction of the Highway 267 Bypass is underway. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF <br />TRUCKEE, AS FOLLOWS: <br /> <br /> 1. The Town Council hereby finds that the Western Undercrossing and the signalization of the <br />Highway 267/Palisades Drive are alternative major transportation improvements as described in Land Use <br />Policy 3.5. <br /> <br /> 2. The Community Development Department may accept discretionary land use development <br />applications along the Highway 267 corridor, and these applications may be considered and approved in <br />accordance with the Town Zoning Ordinance and Subdivision Ordinance. <br /> <br /> 3. Discretionary land use development applications that would result in a net increase in traffic <br />at Highway 267 and Commercial Row shall be subject to the following condition: "No grading or building <br />permits shall be issued until the Western Undercrossing and Highway 267/Palisades Drive signalization <br />projects are completed and construction for the Highway 267 Bypass has commenced as determined by the <br />Community Development Director." Construction commencement for the Bypass shall be the initiation of <br /> <br /> <br />
