Town of Truckee <br /> <br />California <br /> <br />ORDINANCE NO. 93-16 <br /> <br />AN URGENCY ORDINANCE OF THE TOWN OF TRUCKEE <br />IMPLEMENTING TRANSFER OF COUNTY SERVICE AREA (CSA) <br />AUTHORITY FROM THE COUNTY OF NEVADA TO THE TOWN OF <br />TRUCKEE FOR CSA'S 4, 5, 6, 8, 9, 10, 11, 19 AND 35 <br /> <br />The Town Council of the Town of Truckee Does Ordain as Follows: <br /> <br /> WHEREAS, the Nevada County Local Agency Formation Commission (LAFCo) <br />adopted Resolution 92-06 on June 25, 1992, providing for terms and conditions for the <br />incorporation of the Town of Truckee and that County Service Areas (CSA) 4, 5, 6, 8, 9, 10, <br />11, 19 and 35 for snow removal and road maintenance shall be transferred to the Town, and <br />that as the successor agency the Town shall continue to have full authority to levy parcel <br />charges, adjusted on an annual basis within the areas of the CSAs, and that all funds derived <br />from parcel charges and any State subventions for such services and reserves held on the <br />date of transfer and all delinquent parcel charges collected by the County for the CSAs shall <br />be distributed to the Town, and parcel charges collected shall be maintained in a separate <br />fund for each CSA and expended only for snow removal and road maintenance and <br />improvement purposes within each respective CSA; and <br /> <br /> WHEREAS, the Board of Supervisors of the County of Nevada adopted its <br />Resolution No. 92483 on July 21, 1992, ordering the incorporation of the Town of Truckee <br />subject to the confirmation of the voters therein, and which by paragraph 11 of said <br />resolution provides that the services and obligations, rights, duties, parcel charges, reserves, <br />equipment, facilities and other assets of the CSAs for snow removal and road maintenance <br />shall be transferred to the new Town; that the Town shall continue to have full authority <br />to levy parcel charges, adjusted on an annual basis, within the area of the former CSAs; that <br />all funds derived from these parcel charges and any state subventions for such services, and <br />reserves held by CSAs and all delinquent parcel charges collected by the County for the <br />CSAs shall be distributed to the Town and shall be maintained in a separate fund and <br />expended only for snow removal and road maintenance and improvement purposes within <br />the areas of the respective CSAs; and <br /> <br /> WHEREAS, on November 3, 1992, at the general election, Measure H was submitted <br />to the voters as follows: <br /> <br />"Shall the order adopted on July 21, 1992, by Resolution No. 92-483 of the <br />Board of Supervisors of Nevada County ordering the incorporation of the <br />unincorporated community of Truckee (LAFCO 91-02), and the <br />reorganization of County Service Areas 4, 5, 6, 7, 8, 9, 10, 11, 19, and 35 and <br />the Donner Terrace and Prosser Woods Permanent Road Divisions as <br />described in the order be confirmed subject to the terms and conditions <br />specified in the order?"; and <br /> <br /> <br />
