<br />I <br /> <br />I <br /> <br />I <br /> <br />TOWN OF TRUCKEE <br />California <br /> <br />ORDINANCE 2008-11 <br /> <br />AN ORDINANCE AMMENDING TITLE 15, TO ESTABLISH A PERMIT EXTENSION <br /> <br />'. <br /> <br />The. Town Council of the Town of Truckee Does Ordain as Follows: <br /> <br />Section 1. Enactment. Title 15, of the Truckee Municipal Code is hereby amended as <br />follows: <br /> <br />Add the following section to the Town Municipal Code: <br /> <br />15.03.015 Permit Application Extension <br />The following new section shall be added to the California Building Code <br />Appendix Chapter 1, Section 105.3: <br /> <br />105.3.3 Permit Application Extension. A one time 180-day extension is available <br />for building permits initially applied for between the dates of July 1, 2007 and <br />March 31,2008 that will extend the application not beyond June 30, 2009 upon <br />written request bY,the applicant alld payment of fees therefore. This extension is <br />in addition to the initial' 180 day application and 180 day extension already <br />granted by the code. The fee therefore is the difference between the building <br />plan check and building permit fees at the time of application and those fees that <br />are effective on Novemb~r 1, 2008. \ <br /> <br />, . <br />Whereas, Section 107.4 of the 2001 edition of the California Buildirig Code p'rqvid~~ that <br />permits must be obtained within 180 days of the initial date of application; and, the code allows the <br />building official to approve a one time extension of up to 180 days; and ' <br /> <br />Whereas, the construction industry is experiencing economic challenges, specifically <br />obtaining permanent and construction financing is presently difficult to impossible; the following <br />. extension will enable permit applicants additional time within which financing should become <br />available; and <br /> <br />Whereas, the Health and Safety Code Sections 18941.5 and 17958 permit the Town to <br />make su'ch changes or modifications to the Codes as are reasonable necessary because of local <br />conditions; and <br /> <br />. VVhereas, the Health Code Sections 18941.5, 17958.5 and 17958.7 make express findings <br />that such changes or modifications are needed due to climatic, geographic or topographic <br />conditions; and <br /> <br />Whereas, the Town Building Official has recommended that a change is made to the code <br />that is reasonably necessary due to local conditions in the Town of Truckee and is of a procedural <br />nature; and <br /> <br />Whereas, the Town Council of the Town of Truckee makes the express finding that said <br />change to the Code is necessary for administrative purposes. <br />
