<br />TOWN OF TRUCKEE <br />California <br /> <br />I <br /> <br />ORDINANCE 2008-10 <br /> <br />AN ORDINANCE ALLOWING THE TOWN OF TRUCKEE EXPRESSIVE ACTIVITIES AND <br />SPECIAL EVENTS POLICY <br /> <br />The Town Council of the Town of Truckee Does Ordain as Follows: <br /> <br />Chapter 9.05. Expressive Activities and Special Events <br /> <br />Section 9.05 Purpose. <br />This article is adopted for the purpose of regulating parades, free speech events, special <br />events, and public assemblies occurring in whole or in part on or within a Town street, parking <br />facility, sidewalk or other public right-of-way or on private property which obstruct, delay or <br />otherwise interfere with the normal flow of vehicular or pedestrian traffic, or which do not comply <br />with applicable traffic laws or controls. <br /> <br />Section 9.05.020 Definitions. <br />Unless the contrary is stated or clearly appears from the context, the following definitions shall <br />govern the construction of the words and phrases used in this chapter. <br /> <br />I <br /> <br />A. "Aggrieved Person" means any person who is adversely affected by a determination made or <br />actien taken by a Town officer or employee pursuant to' the provisien's of tnis chapter in a <br />manner significantly greater than the public generally, including, but not limited to, any <br />applicant for a permit required by this chapter who is adversely affected by the action of the <br />Chief of Police on such permit. <br /> <br />B. "Chief of Police" means the Chief of Police or his/her designee. <br /> <br />C. "Town Manager" means the Town Manager or his/her designee. <br /> <br />D. "Event" means any' parade, free speech event or public assembly, <br /> <br />E. "Free Speech Rights" means expressive activity protectEid by the First Amendment of the <br />United States Constitution or Article I, Section 2 of the California Constitution; provided, that <br />such activity is the principal purpose of the event. <br /> <br />F. "Parade" means any organized march or organized procession of animals, vehicles or <br />persons (other than public employees acting within the course and scope of their <br />employment) on or within a Town street, parking facility, sidewalk or other public right-of- <br />way, other than a group of people participating in a free speech event or public assembly. <br /> <br />G. "Public Assembly" means any group of people participating in an organized activity (other <br />than public employees acting within the course and scope of their employment) on or within <br />a Town street, parking facility, sidewalk or other public right-of-way, other than a group of <br />people participating in a free speech event or parade. <br /> <br />I <br /> <br />H. "Special Event" means those commercial and community activities subject to the Town <br />special events policy adopted by resolution of the Town Council from time to time. <br />
