TOWN OF TRUCKEE <br /> California <br /> ORDINANCE NO. 2017-06 <br /> AN ORDINANCE OF THE TOWN OF TRUCKEE <br /> APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE TOWN OF TRUCKEE AND <br /> TRUCKEE DEVELOPMENT ASSOCIATES, LLC <br /> The Town Council of the Town of Truckee Does Ordain as Follows: <br /> Section 1. Enactment. The Development Agreement for the Truckee Railyard Mixed-Use <br /> Development Master Plan set forth in Exhibits A and B, is hereby approved. Assessor's Parcel <br /> Numbers 19-111-07; 19-420-68, 19-420-69, 19-420-70, 19-420-71 and 19-420-72 shall be subject <br /> to the terms and conditions of the Development Agreement. <br /> Section 2. Enactment. The Town Manager is hereby directed to execute the Development <br /> Agreement, on file in the Clerk's Office, upon execution by the property owner. This authorization <br /> shall be valid for a period of 30 days from the effective date of this Ordinance at which time the <br /> authorization to execute the agreement provided by this Ordinance shall become null and void. The <br /> Town Manager is hereby further directed to record this Ordinance, within 10 days of its execution, <br /> with the Nevada County Recorder. <br /> Section 3. Enactment. The Town certified the Railyard Master Plan Final Environmental <br /> Impact Report (SCH #2007122092) in July 2009 based on a finding that the Railyard Master Plan <br /> will not result in significant environmental impacts with the incorporation of mitigation measures with <br /> the exception of Impact TRAF-7, Impact TRAF-11, Impact TRAF-15, Impact AIR-2, Impact NOI-1, <br /> and Impact CULT-1 for which the impacts are identified as significant and unavoidable and <br /> overriding considerations were adopted. The Railyard Development Agreement is a project under <br /> the California Environmental Quality Act (CEQA) and the Council finds the Railyard Development <br /> Agreement exempt from CEQA pursuant to CEQA Guidelines Section 15183 (Project Consistent <br /> with a Community Plan, General Plan or Zoning) and Section 15162 (Subsequent EIRs and <br /> Negative Declarations). <br /> Section 4. Findings. The findings set forth in Exhibit C are hereby adopted in support of <br /> approval of the Development Agreement. <br /> Section 5. Summary Publication and Posting. Within thirty(30)days after final adoption of <br /> this Ordinance, the Town Clerk shall have a summary of the ordinance prepared by the Town <br /> Attorney and published as required. Within fifteen (15) days after final adoption of this Ordinance, <br /> the Town Clerk shall have it posted in the three (3) public places designated by Resolution of the <br /> Council. <br /> The foregoing Ordinance was introduced at a regular meeting of the Truckee Town Council <br /> held on the 11th day of July, 2017, and adopted ata regular meeting of the Truckee Town Council, <br /> on the 25th day of July, 2017, by Vice Mayor Wallace Dee,who moved its introduction,which motion <br /> was seconded by Council Member Tirman was upon roll call carried by the following vote: <br /> Ordinance 2009-04 <br /> Page 1 <br />
