TOWN OF TRUCKEE <br /> California <br /> ORDINANCE 2016-15 <br /> AN ORDINANCE ADOPTING PROCEDURES FOR THE ESTABLISHMENT OF <br /> UNDERGROUND UTILITY DISTRICTS AND <br /> ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 1 <br /> WHEREAS, the Truckee Town Council, at a public hearing held on October 25, 2016, <br /> adopted Resolution 2016-53, declaring its intention to establish Underground Utility District No. <br /> 1; and <br /> WHEREAS, the Truckee Town Council directed a public hearing to be held on <br /> December 13, 2016, as the time and place of hearing protests and receiving testimony for and <br /> against the proposed action; and <br /> WHEREAS, notice was given of the time and place for the public hearing stated in the <br /> manner provided by law; and <br /> WHEREAS, the public hearing occurred at the time and place of which notice was <br /> given; and <br /> WHEREAS, all written protests and other written communications were publicly read <br /> at the meeting and evidence duly taken and all persons desiring to be heard were fully heard; <br /> The Town Council'of the Town\of Truckee Does Ordain as Follows: <br /> Section 1. The removal of\, <br /> olesand overhead lines and associated overhead structures from <br /> that certain area described in Resolution 2016-53 is in the interest of public health and safety. <br /> Section 2. The Truckee Municipal Code is hereby amended by adopting and adding thereto <br /> Chapter 13.06, as set forth in Attachment"A". <br /> Section 3. The Town Council hereby finds that the adoption of this ordinance is categorically <br /> exempt from the California Environmental Quality Act under CEQA Guidelines Section 15302(d) <br /> (conversion of overhead electric distribution facilities to underground). <br /> Section 4. This ordinance shall become effective upon the expiration of thirty (30) days from its <br /> passage. <br /> Section 5. If any section, subsection, sentence, clause or phrase of this Ordinance is for any <br /> reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision <br /> shall not affect the validity of the remaining portions of the Ordinance. The Town Council of the <br /> Town of Truckee hereby declares that it would have passed this Ordinance and each section, <br /> 111 <br /> subsection, sentence, clause and phrase thereof irrespective of the fact that one or more <br /> sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. <br />
