TOWN OF TRUCKEE <br /> California <br /> ORDINANCE 2016-11 <br /> AN ORDINANCE AMENDING SECTION 3.24.060 OF THE <br /> TRUCKEE MUNICIPAL CODE REGARDING <br /> TRANSIENT OCCUPANCY TAX REGISTRATION <br /> WHEREAS, the Town Council has previously adopted Section 3.24.060 of the <br /> Municipal Code, requiring any operator of a "hotel" (i.e. a lodging unit of any type) renting to <br /> occupants for less than 30 days to register with the Town's tax administrator and obtain a <br /> "Transient Occupancy Registration Certificate"; and <br /> WHEREAS, the Town has received data indicating that some hotel operators are <br /> renting on a transient basis without registering, obtaining a certificate, or remitting transient <br /> occupancy tax; and <br /> WHEREAS, restating the existing prohibition against offering transient rentals without <br /> a Transient Occupancy Registration Certificate, and requiring all advertisements for transient <br /> rentals to list the operator's certificate number, will encourage compliance with the registration <br /> requirement and will assist the Town in its efforts to ensure that transient occupancy tax is <br /> collected and remitted; <br /> WHEREAS, all legal prerequisites for the adoption of this ordinance have been met; <br /> The Town Council of the Town of Truckee Does Ordain as Follows: <br /> Section 1. <br /> The Town Council hereby amends Section 3.24.060 of the Truckee Municipal <br /> Code to read as follows: <br /> 3.24.060 Registration <br /> Within thirty days after commencing business, each operator of any hotel renting <br /> to transients must register the hotel with the tax administrator and obtain a <br /> "Transient Occupancy Registration Certificate" to be posted at all times in a <br /> conspicuous place on the premises. The Certificate shall state, among other <br /> things, the following: <br /> (a) The name of the operator, and owner if different; <br /> (b) The address of the hotel; <br /> (c) The date upon which the Certificate was issued; <br /> (d) "This Transient Occupancy Registration Certificate signifies that the <br /> person named on the face hereof has fulfilled the requirements of the <br /> Uniform Transient Occupancy Tax by registering with the tax <br /> administrator for the purpose of collecting from transients the <br /> ' Transient Occupancy Tax and remitting the tax to the tax <br /> administrator. This Certificate does not authorize any person to <br /> conduct any unlawful business or to conduct any lawful business in an <br /> unlawful manner, nor to operate a hotel without strictly complying with <br />
