TOWN OF TRUCKEE <br /> California <br /> ORDINANCE 2016-13 <br /> AN ORDINANCE AMENDING DEVELOPMENT CODE SECTION 18.92.095 <br /> REGARDING DEDICATIONS OF LAND FOR PARK PURPOSES <br /> WHEREAS, the Quimby Act, codified as Section 66477 of the California Government <br /> Code, allows a city to require the dedication of land or impose a requirement of the payment of <br /> fees in lieu thereof, or a combination of both, for park or recreational purposes as a condition to <br /> the approval of a tentative map or parcel map; and <br /> WHEREAS, the Town is allowed to require dedication of land or payment of fees in <br /> lieu of dedication of land can unless the amount of existing neighborhood and community park <br /> area at a standard of five acres per 1,000 persons residing within a subdivision, if the amount of <br /> existing neighborhood and community park area exceeds that amount, as derived from the ratio <br /> that the amount of existing neighborhood and community park acreage bears to the total <br /> population of the Town as shown in the most recent available federal census; and <br /> WHEREAS, the existing neighborhood and community park acreage in Truckee <br /> exceeds five acres per 1,000 residents, and the Town Council has previously approved a land <br /> dedication and/or in-lieu fee payment reflecting a standard of five acres per 1,000 residents, and <br /> ' now wishes to codify this standard in the Truckee Municipal Code; and <br /> WHEREAS, all legal prerequisites for the adoption of this ordinance have been met; <br /> The Town Council of the Town of Truckee Does Ordain as Follows: <br /> Section 1. The Town Council hereby amends Section 18.92.095 of the Truckee Municipal <br /> Code to read as follows: <br /> • 18.92.095— Parks and Recreation. <br /> A. Park and recreational fee. As a condition of approval of any tentative <br /> map, a park and recreational fee in the amount set by Council resolution <br /> shall be paid for each and every newly created parcel. Common area, <br /> open space, and similar parcels shall be exempt from the fee if <br /> enforceable restrictions are imposed on the parcel prohibiting residential <br /> development on the parcel. Condominium and townhouse parcels for <br /> which recreational facilities impact fees have been paid for the <br /> construction of the multi-family residential structure(s) on said parcels <br /> shall be exempt from the fee. The fee shall be calculated by multiplying <br /> the fair market value of vacant land in Truckee suitable for parkland by <br /> the number of acres resulting from the calculation in subsection C below. <br /> Any fees collected pursuant to this subsection A shall be expended in <br /> compliance with Government Code Section 66477. <br />
