TOWN OF TRUCKEE <br /> California <br /> ORDINANCE 2016-10 <br /> AN ORDINANCE OF THE TOWN OF TRUCKEE <br /> AMENDING THE OLD GREENWOOD PLANNED DEVELOPMENT DEVELOPMENT <br /> AGREEMENT BETWEEN THE TOWN OF TRUCKEE AND NORTHLIGHT OLD <br /> GREENWOOD ACQUISITION, LLC <br /> WHEREAS, the Old Greenwood Planned Development executed a Development <br /> Agreement on August 14, 2002 to promote the public interest and welfare of the Town; <br /> WHEREAS, the Old Greenwood Planned Development Development Agreement <br /> included a project description and outlined the requirements and expectations of the project <br /> approval; and <br /> WHEREAS, the Development Agreement outlines the procedures for Town Council <br /> approval for amendments to the Development Agreement; and <br /> WHEREAS, the proposed Old Greenwood Project Amendment #4 proposes to amend <br /> the project description for the Old Greenwood Planned Development; and <br /> WHEREAS, the Permitted Uses and Density and Intensity of Uses and Site Plan and <br /> Tentative Maps of the Development Agreement are required to be amended to maintain <br /> consistency with the proposed Planned Development Project Amendment and Tentative Maps; <br /> The Town Council of the Town of Truckee Does Ordain as Follows: <br /> Section 1. <br /> Enactment. The Development Agreement Amendment No.3 concerning the Old <br /> Greenwood Planned Development Project, which is on file in the office of the Town Clerk and <br /> incorporated herein by reference as if fully set forth, is hereby approved. Assessor's Parcel <br /> Numbers 19-720-01 to -14, 19-730-01 to 19-730-02, 19-730-05, 19-730-07, 19-730-09, 19-730- <br /> 10 to -24, 19-730-27 to 19-730-40, 19-740-02 to -67, 19-750-01 to -40, 19-760-02 to -03, 19- <br /> 760-05 to -33, 19-940-01 to -18, also known as the shall be subject to the terms and conditions <br /> of the Development Agreement Amendment No. 3. The Development Agreement Amendment <br /> No. 3 of the Old Greenwood Planned Development is described in Exhibit "A", attached hereto <br /> and incorporated herein. <br /> Section 2. <br /> Enactment. The Town Manager is hereby directed to execute the Development <br /> Agreement Amendment No. 3 upon the property owner's execution by the property owner. This <br /> authorization shall be valid for a period of 30 days from the effective date of this Ordinance at <br /> which time the authorization to execute the agreement provided by this Ordinance shall become <br /> null and void. The Town Manager is hereby further directed to record this Ordinance, within 10 <br /> days of its execution, with the Nevada County Recorder. <br /> Section 3. <br />
