TOWN OF TRUCKEE <br /> California <br /> ORDINANCE 2016-09 <br /> AN ORDINANCE OF THE TOWN OF TRUCKEE <br /> AMENDING THE TOWN OF TRUCKEE ZONING MAP FOR <br /> OLD GREENWOOD PROJECT AMENDMENT#4 <br /> WHEREAS, the Old Greenwood Planned Development utilizes the maximum density <br /> allowed within the project area; and <br /> WHEREAS, the Town of Truckee has received an application from Northlight Old <br /> Greenwood Acquisition, LLC, a partial owner of the Old Greenwood Planned Development, <br /> requesting Project Amendment #4 which proposes conversion of 82 fractional ownership units <br /> to 66 whole ownership residential units, which requires an increase in the allowed density; and <br /> WHEREAS, in order to approve the proposed Old Greenwood Project Amendment#4, <br /> the Zoning Map must be amended to allow an increase in density in the Old Greenwood <br /> Planned Development; <br /> The Town Council of the Town of Truckee Does Ordain as Follows: <br /> Section 1. <br /> Enactment. The Town of Truckee Zoning Map is hereby amended, thereby modifying <br /> the zoning district on the property known as Assessor's Parcel Number 19-720-14 from RS-2.0 <br /> (Single-Family Residential, two dwelling units per acre) to RS-6.0 (Single-Family Residential, six <br /> dwelling units per acre) as shown on Exhibit A attached hereto and incorporated herein. <br /> Section 2. <br /> Findings. The Council hereby adopts the following findings in support of the adoption of <br /> this ordinance: <br /> A. The proposed amendment to the Zoning Map ensures and maintains internal <br /> consistency with all of the goals, policies and actions of all elements of the General Plan and <br /> any applicable specific plan. The Council staff report dated August 23, 2016; the Council <br /> minutes of the August 23, 2016 public hearing; and the Planning Commission staff report dated <br /> July 19, 2016 .are hereby incorporated herein by reference and provide a factual basis for the <br /> findings. <br /> B. The proposed amendment would not be detrimental to the public interest, health, <br /> safety, convenience or welfare of the Town. The Council staff report dated August 23, 2016; the <br /> Council minutes of the August 23, 2016 public hearing; and the Planning Commission staff <br /> report dated July 19, 2016 are hereby incorporated herein by reference and provide a factual <br /> basis for the findings. <br /> C. With the proposed amendment, adequate and available sites remain to mitigate <br /> the loss of any residential density to accommodate the Town of Truckee's fair share regional <br /> housing need in compliance with the State law (Government Code Section 65863[b]). The <br /> 111 <br /> Council staff report dated August 23, 2016; the Council minutes of the August 23, 2016 public <br /> hearing; and the Planning Commission staff report dated July 19, 2016 are hereby incorporated <br /> herein by reference and provide a factual basis for the findings. <br /> D. There is adequate capacity available in the community sewer and water systems <br /> to serve the potential development, and the site is physically suitable for the requested zoning <br />
