TOWN OF TRUCKEE <br /> California <br /> ORDINANCE 2016-04 <br /> AN ORDINANCE ADOPTING CHAPTER 10.21 OF THE <br /> TRUCKEE MUNICIPAL CODE REGARDING VEHICLES ON TRAILS, PROHIBITIONS AND <br /> ALLOWED USES <br /> WHEREAS, Truckee residents, visitors, and workers recreate and travel year-round <br /> on a complete and connected network of bikeways, walkways, and dirt trails; and <br /> WHEREAS, the Town of Truckee does not currently have any restrictions in place <br /> governing what type of vehicles may use trails owned or operated by the Town; and <br /> WHEREAS, the Town of Truckee does not currently have any restrictions in place <br /> prohibiting the reckless operation of human-powered vehicles on trails owned or operated by <br /> the Town; and <br /> WHEREAS, adoption of laws for trail use will help reduce the risk of inappropriate and <br /> unsafe use of the trails; <br /> The Town Council of the Town of Truckee Does Ordain as Follows: <br /> Section 1. <br /> Chapter 10.21 of the Truckee Municipal Code is hereby adopted and enacted to <br /> read as set forth in Exhibit "A", attached hereto and incorporated herein by reference. <br /> Section 2. <br /> If any section, subsection, sentence, clause or phrase of this ordinance is for any <br /> reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision <br /> shall not affect the validity of the remaining portions of the ordinance. The Town Council of the <br /> Town of Truckee hereby declares that it would have passed this ordinance and each section, <br /> subsection, sentence, clause and phrase thereof irrespective of the fact that one or more <br /> sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. <br /> Section 3. <br /> The Town Clerk is hereby directed to publish this ordinance in accordance with <br /> the law. <br />
