TOWN OF TRUCKEE <br /> California <br /> RESOLUTION NO. 2016-07 <br /> A RESOLUTION OF THE TRUCKEE TOWN COUNCIL RESCINDING <br /> RESOLUTION 2007-05 AND REVISING IMPLEMENTATION PROCEDURES <br /> FOR THE COLLECTION OF TRAFFIC IMPACT FEES <br /> WHEREAS, the Truckee Town Council recently enacted Ordinance 2016-03 adopting a <br /> traffic mitigation fee program; and <br /> WHEREAS, Ordinance 2016-03 requires the adoption of a resolution establishing the <br /> implementing procedures for the new fees; and <br /> WHEREAS, the Town Council has previously adopted Resolution 2007-05 establishing <br /> implementing procedures for the collection of Traffic Impact Fees; and <br /> WHEREAS, the Town Council has determined that the implementing procedures set <br /> forth herein are consistent with the requirements established by Ordinance 2016-03. <br /> NOW, THEREFORE, BE IT RESOLVED that the Truckee Town Council hereby adopts <br /> the implementation procedures attached hereto as Exhibit 1 based upon the following findings <br /> and rescinds Resolution No. 2007-05. <br /> Finding 1 - The Town of Truckee Traffic Impact Fee Study Table 2 (Attachment A) contains a <br /> detailed list of construction projects that are the basis of the impact fees charged. In addition, <br /> the Town of Truckee has adopted a 5-year Capital Improvement Plan that specifically identifies <br /> projects necessary to mitigate traffic impacts and earmarks traffic mitigation fees to fund such <br /> projects. The Capital Improvement Plan and Town budget establish specific funds for individual <br /> traffic mitigation projects and appropriates traffic mitigation fee revenues to those projects. <br /> Based upon these factors, it is appropriate to collect traffic impact fees on development projects <br /> at the time of building permit issuance. <br /> Finding 2 - Traffic impact fees paid in accordance with Ordinance 2016-03 and these <br /> implementing rules are collected to fund the capital improvement program identified in Table 2 <br /> of the Town of Truckee Traffic Impact Fee Study and are not designated toward any specific <br /> improvement project. <br /> Finding 3 -All traffic impact fees collected under this program shall be maintained in a separate <br /> account specifically for traffic impact fees. An annual report shall be prepared providing an <br /> accounting of the moneys in the account and the amount and purpose of the moneys spent in <br /> the preceding year. The report shall be presented at a public hearing. <br /> The annual report will also include a review of cost estimates, changes in development <br /> proposals, administrative charges, and DUEs collected. The fee program will be adjusted to <br /> ' reflect any updated information identified in the review. An adjustment may also be applied each <br /> year based upon increases in the Engineering News Record Construction Cost Index. <br />
