TOWN OF TRUCKEE <br /> California <br /> ORDINANCE 2015-12 <br /> AN ORDINANCE AMENDING CHAPTER 10.14 OF THE <br /> TRUCKEE MUNICIPAL CODE TO ADD SECTION 10.14.100 REGARDING NON-ELECTRIC <br /> VEHICLE PARKING IN DESIGNATED ELECTRIC VEHICLE SPACES <br /> WHEREAS, the Town Council wishes to encourage the provision of facilities for <br /> charging electric vehicles; and <br /> WHEREAS, the Town and the Truckee Donner Public Utility District have collaborated <br /> to provide electric vehicle charging stations in the Town-owned parking lot at the Truckee <br /> Depot; and <br /> WHEREAS, Section 22511 of the California Vehicle Code allows the Town to prohibit <br /> the parking of vehicles in spaces designated for electric vehicle charging unless such vehicles <br /> are actively being charged; <br /> The Town Council of the Town of Truckee Does Ordain as Follows: <br /> Section 1. <br /> TITLE 10 VEHICLES and TRAFFIC of the Town of Truckee Municipal Code is <br /> hereby amended by enacting a new Section 10.14.100 in Chapter 10.14 thereof to read as <br /> follows: <br /> 10.14.100 Non-Electric Vehicle Parking in Designated Electric Vehicle Space <br /> A person shall not park or leave standing a vehicle in a stall or space designated <br /> pursuant to Section CVC 22511 unless the vehicle is connected for electric charging <br /> purposes. <br /> Section 2. <br /> If any section, subsection, sentence, clause or phrase of this ordinance is for any <br /> reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision <br /> shall not affect the validity of the remaining portions of the ordinance. The Town Council of the <br /> Town of Truckee hereby declares that it would have passed this ordinance and each section, <br /> subsection, sentence, clause and phrase thereof irrespective of the fact that one or more <br /> sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. <br /> Section 3. <br /> The Town Clerk is hereby directed to publish this ordinance in accordance with <br /> the law. <br />
