TOWN OF TRUCKEE <br />California <br />ORDINANCE 2015-02 <br />AN ORDINANCE AMENDING SECTION 2.04.030 OF THE <br />TRUCKEE MUNICIPAL CODE REGARDING CONDUCT AT MEETINGS <br />WHEREAS, the Town of Truckee is committed to transparent governance and the <br />ability of members of the public to exercise their rights to comment upon and discuss all matters <br />coming before the Town Council and other Town commissions and bodies; and <br />WHEREAS, it is in the interest of the public to ensure that public meetings of the Town <br />Council and other Town bodies allow for opportunities for public comment and discussion, while <br />ensuring that meetings are not disrupted by disorderly conduct on the part of meeting <br />attendees; and <br />WHEREAS, recent guidance from courts examining the regulation of public speech <br />and conduct at public meetings suggests that revisions to Section 2.04.030 of the Truckee <br />Municipal Code are necessary to protect the rights of members of the public while ensuring that <br />Town bodies are able to, conduct meetings free from disruption; and <br />WHEREAS, the Town Council has previously endorsed the goals of the Speak Your <br />Peace Civility Project and encourages all Town officials, employees, and members of the public <br />to endeavor to maintain civility in discourse at Town meetings; <br />The Town Council of the Town of Truckee Does Ordain as Follows: <br />Section 1. <br />Section 2.04.030 of the Truckee Municipal Code is hereby revised in its entirety <br />to read as set forth in Exhibit 'W', attached hereto and incorporated herein by reference. <br />Section 2. <br />If any section, subsection, sentence, clause or phrase of this ordinance is for any <br />reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision <br />shall not affect the validity of the remaining portions of the ordinance. The Town Council of the <br />Town of Truckee hereby declares that it would have passed this ordinance and each section, <br />subsection, sentence, clause and phrase thereof irrespective of the fact that one or more <br />sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. <br />Section 3. <br />the law. <br />1 <br />The Town Clerk is hereby directed to publish this ordinance in accordance with <br />
