CALL TO ORDER. The meeting was called to order at 1:04 p.m. by Zoning Administrator John McLaughlin. Attendees Present: John McLaughlin, Zoning Administrator/Community Development Director; Denyelle Nishimori, Senior Planner; Yumie Dahn, Planning Division Intern; Mike Vaughn, Senior Engineer; Laura Dabe, Administrative Secretary; Item 4.1: Gordon and Kim Cross, Applicant. 2. PUBLIC COMMENT. Zoning Administrator McLaughlin opened public comment at 1:04 p.m. Seeing none, Zoning Administrator McLaughlin closed public comment. 3. APPROVAL OF MINUTES. 3.1 November 20, 2012 – Rescheduled Regular Meeting 4. PUBLIC HEARINGS. 4.1 Application No. 12-029/MUP (Boehmer Garage Addition); Gordon Cross, Lake Tahoe Designs, Applicant; David Boehmer, Owner. Yumie Dahn, Planning Division Intern. The applicant is requesting the following land use permit approvals: (1) Minor Use Permit to construct a new approximately 687-square-foot two-story single-car garage within an existing 10- foot power and telephone easement located along the southern property line; and (2) Minor Use Permit approval to reduce the required 12.5-foot Donner Lake side yard setback to eight feet for the eastern garage wall and 6.5 feet for the garage eaves. Staff Recommendation: That the Zoning Administrator determine the project to be exempt from CEQA pursuant to Section 15303(e) approve the Minor Use Permits based on the recommended findings and subject to the recommended conditions of approval. Planning Division Intern Dahn presented information from the staff report (on file with the Town Clerk). APPLICANT PRESENTATION Gordon Cross, Applicant for Owner David Boehmer: • Project is not setting precedent. • Project will save the existing driveway. McLaughlin: The driveway goes down the slope and is used by others? Cross: Several property owners use the driveway and the owner does not want to create a fight over the easement; it is 100 percent open for use. Zoning Administrator Meeting – December 5, 2012 Page 2 McLaughlin: Is there another way to access those properties? Cross: They all have steep, rickety driveways. There is no winter access. This will provide a covered walkway to the steps to house and provide a place to park off the street. There is currently nowhere to park. McLaughlin: None of the driveway or street parking is plowed? Cross: Typically not. The utilities are out in street, so this is does not affect those. This is a steep lot. McLaughlin: Does the Engineering Division have any concerns? Vaughn: There is enough distance from the edge of pavement to the garage, so that is not a concern. There is already an existing parking pad area; this project would improve the situation to allow for parking out of the right-of-way. PUBLIC COMMENT Zoning Administrator McLaughlin opened public comment at 1:09 p.m. Seeing none, Zoning Administrator McLaughlin closed public comment. Zoning Administrator McLaughlin acted to determine the project to be categorically exempt from CEQA and approved the Minor Use Permits based on the findings stated above and subject to the conditions of approval. Zoning Administrator McLaughlin noted that the 10-day appeal period ends at 5:00 p.m. on Monday, December 17, 2012. 5. ADJOURNMENT. At 1:10 p.m. to the next regularly scheduled meeting on December 19, 2012, at Town Hall in the Upstairs Front Conference Room.
