Town of Truckee <br /> California <br /> <br />ORDINANCE NO. 96-01 <br />(Not to be Codified) <br /> <br /> AN ORDINANCE OF THE TOWN OF TRUCKEE <br /> APPROVING APPLICATION NO. 95-011/ZC AND <br />AMENDING THE TOWN OF TRUCKEE ZONING DISTRICT MAPS <br /> <br /> WHEREAS,the Town of Truckee has received an application to amend the Town Zoning <br />District Maps to modify the Potential Snow Avalanche Area (PSAA) overlay district on APN 17- <br />132-15; and <br /> <br /> WHEREAS, in accordance with Section 65854 of the California Government Code, the <br />Planning Commission has reviewed the requested zoning amendment at a public hearing and <br />formulated a written recommendation to the Town Council; and <br /> <br /> WHEREAS, environmental review has been conducted in accordance with the California <br />Environmental Quality Act (CEQA) and the CEQA Guidelines; and <br /> <br /> WHEREAS,the Town Council has reviewed the requested amendment at a public hearing <br />and considered all information and public comment related thereto. <br /> <br />The Town Council of the Town of Truckee Does Ordain as Follows: <br /> <br /> Section 1. Application No. 95-011/Zoning Change (Lewis PSAA Rezoning), modifying <br />the avalanche hazard designation of the Potential Snow Avalanche Area (PSAA) Combining/Overlay <br />district within APN 17-132-15 from the Red Zone (High Avalanche Hazard) designation to the Blue <br />Zone (Moderate Avalanche Hazard) designation, is hereby approved. <br /> <br /> Section 2. The Town of Truckee Zoning District Maps are hereby amended to indicate <br />that the parcel known as APN 17-132-15 is located entirely within the Potential Snow Avalanche <br />Area Combining/Overlay District - Blue Zone (Moderate Avalanche Hazard). <br /> <br />Section 3. The amendment is based on the following findings: <br /> <br /> a. There is a reasonable probability that the action proposed by this <br />project will be consistent with the general plan proposal being studied and considered by the Town <br />of Truckee. There is little or no probability of substantial detriment to or interference with the future <br />adopted general plan if the proposed action is ultimately inconsistent with the plan. The project will <br />not eliminate planning options for the site or area and is not inconsistent with any of the guiding <br /> <br /> <br />
