Town of Truckee <br /> ORDINANCE 96-03 <br /> <br /> AN UNCODIFIED ORDINANCE ESTABLISHING <br /> THE TERMS OF A FRANCHISE WITH SOUTHWEST GAS <br /> CORPORATION, TO LAY AND USE PIPE AND APPURTENANCES <br />FOR TRANSMISSION AND DISTRIBUTION OF GAS UNDER TOWN STREETS <br /> <br />The Town Council of the Town of Truckee does hereby ordain as follows: <br /> <br />Section 1: FRANCHISE GRANTED <br /> <br /> That the right, privilege and franchise, subject to each and all of the terms and conditions <br />contained in this ordinance, and pursuant to the provisions of Truckee Town Charter Section 202, <br />as approved by the voters of the Town on June 6, 1995, be and the same is hereby granted to <br />Southwest Gas Cmpomtion, a corporation organized and existing under and by virtue of the laws <br />of the State of California, herein referred to as "Grantee," to lay and use pipes and appurtenances <br />for transmitting and distributing gas for any and all purposes under, along, across or upon the streets <br />of the Town. <br /> <br />Section 2: FRANCHISE AREA: FRANCHISE IN LIEU OF OTHERS <br /> <br /> Grantee, through this establishment of its franchise, shall retain the right, privilege and <br />pemfission to comttuct and use pipelines and appurtenances for transmitting and distributing natural <br />gas under, along, across or upon the public streets and ways, alleys and public places and grounds <br />as the same now or may hereafter exist within the Town of Truckee, County of Nevada, State of <br />California. This grant is made in lieu of all other franchises, fights or privileges owned by Grantee, <br />or by any successor of Grantee, to any fights under this franchise, for transmitting and distributing <br />gas within the limits of the Town, as said limits now or may hereafter exist, and the acceptance of <br />the franchises hereby granted shall operate as an abandonment of ail such franchise, fights and <br />privileges within the limits of the Town, as such limits now or may hereafter exist, in lieu of which <br />this franchise is granted. <br /> <br />Section 3: TERM OF FRANCHISE <br /> <br /> Grantee, its successors and assigns, are hereby granted said franchise, right, privilege and <br />permission hereinabove mentioned for the term of twenty-five (25) years from and after the date of <br />the adoption and passage of this ordinance, or until the same shall, with the consent of Public Utility <br />Commission of the State of California, be voluntary surrendered or abandoned or the Town shall <br />purchase by voluntary agreement or shall condemn and take under the power of eminent domain, <br />in accordance with then existing law, all property actually used and useful in the exercise of said <br /> <br /> <br />
