TOWN OF TRUCKEE <br /> California <br /> <br />ORDINANCE NO. 96-04 <br /> <br />AN ORDINANCE OF THE TOWN OF TRUCKEE INCREASING QUIMBY ACT FEES <br />AND ADDING SECTION 2.26 TO THE TOWN SUBDIVISION ORDINANCE <br /> <br /> WHEREAS, Section 66477 of the Subdivision Map Act, hereinafter referred to as the <br />Quimby Act, authorizes the Town, by ordinance, to require the dedication of land or impose a <br />requirement of the payment of fees in lieu thereof, or a combination of both, for park or recreational <br />purposes as a condition to the approval of a tentative map or parcel map; and <br /> <br /> WHEREAS, The Town presently requires the payment of fees for park or recreational <br />purposes in the amount of $750 per newly created parcel; and <br /> <br /> WHEREAS, The Board of Directors of the Truckee Donner Recreation and Park District <br />(hereafter "District") requests that the Town Council increase the fee from $750 to $1,009.51 per <br />newly created parcel; and <br /> <br /> Wlt~,REAS,the District has prepared a mitigation fee study which supports the increase in <br />the fee and demonstrates that the fee complies with the requirements &the Quimby Act; <br /> <br /> WgI-EREAS,the Town Council held public hearings on the matter on February 15, 1996 and <br />March 21, 1996 and considered all public comments and input received on the matter; and <br /> <br /> WI~EREAS,the Town Council adopted Resolution No. 96-16 approving the increase of the <br />Quimby Act fee from $750 to $1,009.51 per newly created parcel. <br /> <br />The Town Council of the Town of Truckee Does Ordain as Follows: <br /> <br /> Section 1. Enactment. The Truckee Subdivision Ordinance, adopted by Ordinance No. <br />95-08, is hereby amended to add Section 2.26 as follows: <br /> <br />Sec.2.26 Dedication of Land and Payment of Fees for Park and Recreational Pu~oses <br /> <br />As a condition of approval of any tentative map, a park and recreational fee shall be <br />paid for each and every newly created parcel in the amount of $1,009.51. Common <br />area, open space, and similar parcels shall be exempt from the fee if enforceable <br />restrictions are imposed on the parcel prohibiting residential development on the <br />parcel. Condominium and townhouse parcels for which recreational facilities impact <br />fees have been paid for construction of the multi-family residential structure(s) on <br />said parcels shall be exempt from the fee. <br /> <br /> <br />
