TOWN OF TRUCKEE <br /> California <br /> <br />RESOLUTION NO. 2002-23 <br /> <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br /> DENYING THE APPEAL OF APPLICATION NO. 02-0041UP-HDR <br /> <br /> WHEREAS, the Sierra Business Council submitted an application requesting <br />approval of a use permit and certificate of appropriateness to expand the Sierra <br />Business Council office and to make exterior modifications to an historic building; and <br /> <br /> WHEREAS, the Town of Truckee Planning Commission, as the authorized <br />review body for use permits and at a duly noticed public hearing, adopted Resolution <br />No. 2002-08 on May 8, 2002, thereby approving the use permit and certificate of <br />appropriateness with conditions, and adopting findings in support of such actions; and <br /> <br /> WHEREAS, Thomas Grossman submitted an appeal of the Commission's <br />decision to approve the use permit and certificate of appropriateness with conditions; <br />and <br /> <br /> WHEREAS, the Town Council is responsible for considering appeals of Planning <br />Commission decisions and considered the appeal at a duly noticed public hearing; and <br /> <br /> WHEREAS, the Town Council received testimony on the appeal from the <br />appellant, applicant, and all other persons wishing to provide testimony and considered <br />such testimony in their decision. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE <br />TOWN OF TRUCKEE as follows: <br /> <br />1. The Council hereby denies the appeal of Thomas Grossman; <br /> <br /> 2. The Council hereby affirms the decisions of the Planning Commission <br />finding the project categorically exempt from the California Environmental Quality Act <br />and approving the use permit and certificate of appropriateness with conditions as set <br />forth in Commission Resolution No. 2002-08. <br /> <br /> BE IT FURTHER RESOLVED, the Town Council adopts the findings set forth in <br />Exhibit "B" (Findings) of Commission Resolution No. 2002-04 in support of the Council's <br />actions to deny the appeal and affirm the decisions of the Planning Commission. <br />Further, the Council accepts the evidence and information provided in the Town Council <br />Staff Report prepared for the appeal hearing as further support of these actions. <br /> <br /> <br />
