TOWN OF TRUCKEE <br /> California <br /> <br />ORDINANCE NO. 2000--03 <br /> <br /> AN ORDINANCE OF THE TOWN OF TRUCKEE AMENDING TOWN <br /> ZONING DISTRICT MAPS AND DOWNTOWN ZONING TEXT <br />AND TO APPROVE A DOWNTOWN PLANNED DEVELOPMENT PLAN <br /> <br /> WHEREAS, the Town of Truckee has received an application to amend the Town Zoning District <br />Maps and Downtown Zoning Text and to approve a Downtown Planned Development Plan; and <br /> <br /> WHEREAS, in accordance with Section 65854 of the California Government Code and Town <br />procedures, the Planning Commission has reviewed the requested zoning amendments and the Downtown <br />Planned Development Plan within a public hearing and formulated a written recommendation to the Town <br />Council in the form of Planning Commission Resolution 2000-04; and <br /> <br /> WHEREAS, the Town Council has adopted a mitigated negative declaration for the zoning <br />amendments and Downtown Planned Development as documented in Town Council Resolution 2000-45; and <br /> <br /> WHEREAS, the Town Council has reviewed the requested zoning amendments and Downto~vn <br />Planned Development Plan within a public hearing and considered all information and public comment related <br />thereto. <br /> <br />The Town Council of the Town of Truckee Does Ordain as Follows: <br /> <br /> Section 1. Enactment. The Downtown Zoning Map (Figure 11.1) is hereby amended to <br />designate the zoning district on APN 19-420-18 Medium Density Residential and to designate APN 19-420-13 <br />as within the Downtown Planned Development Overlay District as shown in Exhibit 1 attached. <br /> <br /> Section 2. The test of the Downtown Zoning (Downtown Truckee Specific Plan, Volume 3 DSA <br />Zoning Ordinance) is modified to allow for residential units with a density not to exceed 4 units per acre when <br />located adjacent to or directly above commercial occupancies within the Visitor Lodging Zoning District and <br />to identify the existence of the approved Downtown Planned Development Plan within table 11.5. The specific <br />modifications to the zoning text are attached as Exhibit 2. <br /> <br /> Section 3. Approval of a Downtown Planned Development Plan for Assessor's Parcel 19-420-13 <br />as delineated in Exhibit 3 attached hereto. <br /> <br /> Section 4. The actions delineated in Sections 1, 2 and 3 above shall become effective upon the <br />execution of a development agreement between the property owner and the Town of Truckee. <br /> <br /> Section 5. Summary Publication and Posting. Within thirty (30) days after final adoption of this <br />Ordinance, the Town Clerk shall have a summary of the ordinance prepared by the Town Attorney and <br />published as required. Within fifteen (15) days after final adoption of this Ordinance, the Town Clerk shall <br />have it posted in the three (3) public places designated by Resolution of the Council. <br /> <br /> <br />
