Town of Truckee <br /> California <br /> <br /> RESOLUTION NO. 2003-39 <br /> <br /> A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br /> ABANDONING A TEN FOOT (10') PUBLIC UTILITY EASEMENT ON PARCEL <br /> NUMBERS 45-240-23 AND 45-240-24(SCALMANINI) <br /> <br /> WHEREAS, the Town of the Truckee has received a request from the <br />property owner to vacate and abandon a ten (10) foot public utility easement <br />located on each side of the common property lines of lots 404 and 405 of Unit 8 <br />of the Tahoe Donner Subdivision, (APN 45-240-23 and 45-240-24); <br /> <br /> WHEREAS, environmental review has been conducted in accordance with <br />the California Environmental Quality Act (CEQA) and the CEQA Guidelines and <br />the Town Council has determined the project will not have a significant impact on <br />the environment and is exempt from environmental review in accordance with <br />Section 15061(b)(3) of the CEQA Guidelines; and <br /> <br /> WHEREAS, no special districts, agencies or utilities have indicated they <br />use the easement nor intend to use the easement; and <br /> <br /> WHEREAS, said easement has not been used for the purpose for which it <br />was dedicated or acquired for five consecutive years immediately preceding this <br />proposed abandonment; <br /> <br /> WHEREAS, the Town Engineer and the Community Development <br />Department Director have reviewed the proposed reduction and find the <br />easement no longer necessary for public purposes; and <br /> <br /> WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways <br />Code, Section 8335, et seq., provides a procedure for summary reduction of <br />easements; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF <br />THE TOWN OF TRUCKEE, <br /> <br /> 1. The ten foot (10') public utility easement located along the common <br /> side boundary line of Lots 404 and 405 of the Tahoe Donner <br /> Subdivision, as describes as follows: The 5-foot public utility <br /> easement along the east property line of Lot 405 and the 5-foot <br /> public utility easement along the west property line of Lot 404 both <br /> of the Tahoe Donner Subdivision Unit no. 8, located in and being a <br /> portion of Sections 4 and 9, Township 17 North, Range 16 East. <br /> M.D.M., in the unincorporated territory of Nevada County, California <br /> <br /> <br />
