Town of Truckee <br /> California <br /> <br /> RESOLUTION NO. 2003-38 <br /> <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br />ABANDONING A TEN FOOT ('10') PUBLIC UTILITY EASEMENT ON PARCEL <br />NUMBERS 16-390-27 AND '16-410-28(PARKER) <br /> <br /> WHEREAS, the Town of the Truckee has received a request to vacate and <br /> abandon a ten (10) foot public utility easement located on each side of the <br /> common property lines of lots 296 and 297 of Unit 3 of the Prosser Lakeview <br /> Estates Subdivision, (APN 16-390-27 and 16-410-28); <br /> <br />WHEREAS, environmental review has been conducted in accordance with the <br />California Environmental Quality Act (CEQA) and the CEQA Guidelines and the <br />Town Council has determined the project will not have a significant impact on the <br />environment and is exempt from environmental review in accordance with <br />Section 15061(b)(3) of the CEQA Guidelines; and <br /> <br />WHEREAS, no special districts, agencies or utilities have indicated they use the <br /> easement nor intend to use the easement; and <br /> <br /> WHEREAS, said easement has not been used for the purpose for which it was <br /> dedicated or acquired for five consecutive years immediately preceding this <br /> proposed abandonment; <br /> <br />WHEREAS, the Town Engineer and the Community Development Department <br />Director have reviewed the proposed reduction and find the easement no longer <br />necessary for public purposes; and <br /> <br />WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code, <br />Section 8335, et seq., provides a procedure for summary reduction of <br />easements; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE <br /> TOWN OF TRUCKEE, <br /> <br /> 1. The ten foot (10') public utility easement located along the common <br /> side boundary line of Lots 296 and 297 of the Prosser Lakeview <br /> Estates Subdivision, as shown on Exhibit A, is hereby summarily <br /> vacated and abandoned. This does not include those portions <br /> within the public utility easements along the western and eastern <br /> property lines. The abandonment shall not become effective and <br /> the Resolution shall not be recorded until the lots are merged and <br /> the Certificate of Merger is recorded.
