Town of Truckee <br /> California <br /> <br /> RESOLUTION NO. 2003-34 <br /> <br /> A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE FOR AN <br /> ABANDONMENT OF AN ACCESS EASEMENT ON 13796 PATHWAY AVENUE <br /> ASSESSOR'S PARCEL NUMBER 45-580-11 <br /> (LELAND FORD) <br /> <br /> WHEREAS, the Town of Truckee has received an application requesting approval of <br />an abandonment, varying in width from 10-feet to twenty-five feet wide, along the southern <br />property boundary of Lot 1, of Tahoe Donner Unit No. 9, of Book 11 of Subdivisions, page <br />67, in the Recorders Office of Nevada County, California, located in Section 35, Township <br />18 North, Range 16 East, M.D.B. & M., subject to the following condition being met by the <br />applicant/owner Leland Ford requesting the abandonment: and <br /> <br /> WHEREAS, environmental review has been conducted in accordance with the <br />California Environmental Quality Act (CEQA) and the CEQA Guidelines and the Town <br />Council has determined the project will not have a significant impact on the environment <br />and is exempt from environmental review in accordance with Section 15061(b)(3) of the <br />CEQA Guidelines; and <br /> <br /> WHEREAS, the Community Development Director, Town Engineer and Public <br />Works Director have reviewed the proposed abandonment and find the easement is no <br />Longer necessary for public purposes; and <br /> <br /> WHEREAS, the easement has been superseded by relocation and the relocation <br />would not cut off all access to a person's property; and <br /> <br /> WHEREAS, there are no public utility facilities located in the easement to be <br />abandoned and the Town has not received any objections to the proposed abandonment <br />from any public utility or special district; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN <br />OF TRUCKEE that the Town adopts this resolution to abandon any and all interest in the <br />10-25-foot access easement, lying along the northern property boundary of the slope <br />easement within of Lot 1, of Tahoe Donner Unit No. 9, of Book 11 of Subdivisions, page <br />67, in the Recorders Office of Nevada County, California, located in Section 35, Township <br />18 North, Range 16 East, M.D.B. & M., subject to the following conditions being met by the <br />applicant/owner Leland Ford requesting the abandonment: <br /> <br /> 1. A 10-foot to 20-foot access easement shall be created along the southern property <br /> boundary, granting driveway access rights to Lots 2 and 3 (APN 45-580-12 and 13). <br /> The manner and documents to create this easement shall be reviewed and <br /> approved by the Town Planner prior to recordation. <br /> <br /> <br />
