TOWN OF TRUCKEE <br /> <br />California <br /> <br />ORDINANCE NO. 93-18 <br /> <br />AN URGENCY ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF <br />TRUCKEE AMENDING THE ADOPTED LAND USE AND DEVELOPMENT <br />CODE BY DELETING CHAPTER XIII SECTIONS L-XIII 1.1 THROUGH L- <br />XIII 1.20 INCLUSIVE RELATING TO IMPLEMENTATION OF THE <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT: <br /> <br /> WHEREAS the Town of Truckee incorporated on March 23, 1993 as a general <br />law city; and <br /> <br /> WHEREAS upon incorporation the Town did adopt by Ordinance No. 2 all rules, <br />regulations and ordinances of the County of Nevada, California as the interim rules, <br />regulations and ordinances of the Town for purposes of administration, continuity and <br />consistency of services; and <br /> <br /> WHEREAS the Town Council deems it urgent and necessary to develop its own <br />rules, regulations and ordinances to regulate processes of development and <br />environmental review procedures; and <br /> <br />WHEREAS the Town Council of the Town of Truckee finds as follows: <br /> <br /> (a) That the preservation, protection and enhancement of the environment is <br />a responsibility of all citizens, agencies, districts, corporations and persons; <br /> <br /> (b) That certainty in the environmental review process is necessary to insure <br />understandable/workable environmental solutions; <br /> <br /> (c) That changes in environmental regulations, laws and guidelines occur <br />frequently within the State due to new legislation, court decisions and rules <br />promulgation from State agencies charged with responsibility for portions of the CEQA <br />process; <br /> <br /> (d) That the current regulations defining the CEQA process as contained in <br />the Nevada County Land Use and Development Code do not provide for sufficient <br />flexibility to adopt amendments or to insure responsiveness necessary to insure adequate <br />and timely CEQA review actions: <br /> <br /> (e) That the guidelines contained in the Nevada County Land Use and <br />Development Code are outdated and in need of amendment to provide proper <br />mitigation for impacts and processes to insure proper reviews. <br /> <br /> <br />
