Town of Truckee <br /> California <br /> RESOLUTION 2017-54 <br /> A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br /> ABANDONING PUBLIC UTILITY EASEMENTS ON <br /> 16095 AND 16065 WOODBRIDGE COURT <br /> ASSESSOR'S PARCEL NUMBERS 49-260-13 AND 49-260-14 <br /> (ROBERT FRENCH) <br /> WHEREAS, the Town of Truckee has received a Lot Line Adjustment and Easement <br /> Abandonment application from Robert French,to adjust the property lines between two lots, Lot#13 <br /> (APN: 49-260-13, 16095 Woodbridge Court) and Lot #14 (APN: 49-260-14, 16065 Woodbridge <br /> Court),of Cambridge Estates Phase 1 subdivision,and abandon two 5-foot public utility easements, <br /> one along the northern side property boundary of Lot#13 and one along the southern side property <br /> boundary of Lot#14 recorded in Book 8 of Subdivisions, page 6, in the Recorders Office of Nevada <br /> County, California; and <br /> WHEREAS, the requested Lot Line Adjustment has been reviewed by Community <br /> Development staff and cannot be completed until two existing public utility easements; and <br /> WHEREAS, environmental review has been conducted in accordance with the California <br /> Environmental Quality Act(CEQA)and the Town Council has determined the project will not have a <br /> significant impact on the environment and is exempt from environmental review in accordance with <br /> Section 15061(b)(3) of the CEQA Guidelines; and <br /> WHEREAS, the Community Development Director and Town Engineer/Public Works <br /> Director have reviewed the proposed abandonment of the two 5-foot public utility easements and <br /> find there is not a public interest in the easements in question,the easements have not been used <br /> for the purpose for which they were dedicated or acquired for five consecutive years immediately <br /> preceding the requested vacation, and the easements are not necessary for present or prospective <br /> use; and <br /> WHEREAS,public utilities and special districts providing utility services have been notified of <br /> the requested abandonment and have either abandoned their respective interests or authorized the <br /> Town to do so; and <br /> WHEREAS,there are no in-place public utility facilities located in the public utility easements <br /> to be abandoned that are in use or would be affected by the abandonment and the Town has not <br /> received any objections to the proposed public utility easement abandonments from any public utility <br /> or special district; and <br /> NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF <br /> TRUCKEE that upon satisfaction of all conditions set forth below,the Town shall abandon any and <br /> all interest in the following: i) The 5-foot public utility easement along the northern side property <br /> boundary of Lot#13,of Cambridge Estates Phase 1;and ii)The 5-foot public utility easement along <br /> the southern side property boundary of Lot#14,exclusive of the 5-foot public utility easements along <br /> the southern side property boundary of Lot 13 and the northern side property boundary of Lot 14, <br /> recorded in Book 8 of Subdivisions, page 6, in the Recorder's Office of Nevada County, California; <br />
