Town of Truckee <br /> California <br /> RESOLUTION NO. 2017-36 <br /> A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br /> ABANDONING A 5'X47' (235 S.F.) PORTION OF A POWER AND TELEPHONE EASEMENT <br /> AND A 15'X47' (705 S.F.) PORTION OF A LIGHT AND AIR EASEMENT ON <br /> 14844 DENTON AVENUE; ASSESSOR'S PARCEL NUMBER 17-290-04 <br /> PLANNING APPLICATION NO. 2017-000000044/ABN <br /> (DON YAKEL) <br /> WHEREAS, the Town of Truckee has received an application from Don Yakel requesting <br /> approval of abandonment of a 5'x 47' (235 s.f.) portion of a power and telephone easement five feet <br /> back from the parcel frontage and a 15' x 47' (705 s.f.) portion of a light and air easement five feet <br /> back from the parcel frontage located on the eastern portion of 14844 Denton Avenue APN 17-290- <br /> 04 or Lot 26 on Donner Heights Unit No. 1 Subdivision Map, recorded in Book 1 of Subdivisions, <br /> Page 125, in the Recorder's Office of Nevada County, California; and <br /> WHEREAS, environmental review has been conducted in accordance with the California <br /> Environmental Quality Act (CEQA) and the CEQA Guidelines and the Planning Commission has <br /> determined the project will not have a significant impact on the environment and is exempt from <br /> environmental review in accordance with Section 15061(b)(3) of the CEQA Guidelines; and <br /> WHEREAS, the Community Development Director, Town Engineer and Public Works <br /> Director have reviewed the proposed abandonment of the 15'x 47'(235 s.f.)portion of a power and <br /> telephone easement five feet back from the parcel frontage and the 15' x 47' (705 s.f.) portion of a <br /> light and air easement five feet back from the parcel frontage and find there is not a public interest in <br /> the easements in question; and <br /> WHEREAS, utility agencies have been notified of the requested abandonment and have <br /> either abandoned their respective interests in the easements or authorized the Town to do so on <br /> their behalf; and <br /> NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF <br /> TRUCKEE: <br /> 1) The Town abandons any and all interest in the following:A 5'x 47'(235 s.f.)portion of a <br /> power and telephone easement five feet back from the parcel frontage and a 15' x 47' <br /> (705 s.f.) portion of a light and air easement five feet back from the parcel frontage <br /> located on the eastern portion of 14844 Denton Avenue APN 17-290-04 or Lot 26 on <br /> Donner Heights Unit No. 1 Subdivision Map, recorded in Book 1 of Subdivisions, Page <br /> 125, in the Recorder's Office of Nevada County, California; and <br /> 2) The applicant/owner, Don Yakel, shall execute and return a signed copy of the Town of <br /> Truckee Indemnity, Hold Harmless,and Defense agreement, attached hereto as Exhibit <br /> C; and <br /> 3) If the applicant/owner, Don Yakel, fail to meet the above conditions for the Easement <br /> Abandonment and have not recorded all required documents, including this Resolution, <br /> by July 11, 2018, this resolution shall become null and void; and <br /> 4) The Town Clerk is hereby authorized and directed to coordinate the recordation of this <br /> resolution upon satisfying that the above-mentioned conditions have been met. <br /> BE IT FURTHER RESOLVED,The Town Council hereby adopts the findings set forth in <br /> Page 1 of 5 <br />
