• <br /> Town of Truckee <br /> California <br /> RESOLUTION 2016-55 <br /> A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br /> ABANDONING A PORTION OF A PUBLIC UTILITY AND MULTI-PURPOSE <br /> EASEMENT ON 16150 PINE STREET <br /> ASSESSOR'S PARCEL NUMBER 17-120-62-000 <br /> (PETER WARNER) <br /> WHEREAS,the Town of Truckee has received an application from Peter Warner requesting <br /> approval of a Tentative Map/Parcel Map Waiver, Summit Creek Floodplain Setback Variance, and <br /> abandonment of a five-foot portion of a 20-foot public utility and multi-purpose easement along the <br /> southern property boundary of Lot 26 of the Donner Lake Woods Phase 2 Subdivision, recorded in <br /> Book 8 of Subdivisions, page 7, in the Recorder's Office of Nevada County, California; and <br /> WHEREAS,the Town of Truckee has processed a Tentative Map/Parcel Map Waiver and <br /> Summit Creek Floodplain Setback Variance as part of this application; <br /> WHEREAS, environmental review has been conducted in accordance with the California <br /> Environmental Quality Act(CEQA) and the CEQA Guidelines and the Town Council has determined <br /> the project will not have a significant impact on the environment and is exempt from environmental <br /> review in accordance with Section 15061(b)(3) of the CEQA Guidelines; and <br /> WHEREAS, the Community Development Director, Town Engineer and Public Works <br /> Director have reviewed the proposed abandonment of the five-foot portion of the 20-foot public utility <br /> and multi-purpose easement and find there is not a public interest in the easements in question;and <br /> WHEREAS, utility agencies have been notified of the requested abandonment and have <br /> either abandoned their respective interests in the easements or authorized the Town to do so on <br /> their behalf; and <br /> NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF <br /> TRUCKEE: <br /> 1) The Town abandons any and all interest in the following: <br /> a) The northern five-foot portion of the 20-foot public utility and multi-purpose <br /> easement along the southern property boundary of Lot 26 of Donner Lake <br /> Woods Phase 2, exclusive of any other easements on the above-mentioned lot <br /> as recorded in Book 8 of Subdivisions, page 7, in the Recorder's Office of <br /> Nevada County, California; <br /> 2) This approval is subject to the following condition being met by the owner/applicant Peter <br /> Warner requesting the abandonment of the five-foot portion of the 20-foot public utility <br /> and multi-purpose easement: <br /> a) Prior to or concurrent with recordation of Resolution 2016-55 for the public utility <br /> 111easement and multi-purpose easement abandonment,the corresponding Record <br /> of Survey shall be recorded; <br /> 3) The applicant/owner, Peter Warner, shall execute and return a signed copy of the Town <br /> of Truckee Indemnity, Hold Harmless, and Defense agreement, attached hereto as <br /> Exhibit B; <br />
