TOWN OF TRUCKEE <br /> California <br /> RESOLUTION 2016-32 <br /> A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br /> RATIFYING THE CONFLICT OF INTEREST CODE <br /> WHEREAS, pursuant to the California Government Code (CGC) commencing with <br /> Section 87300, the Town Council is required to adopt and promulgate a Conflict of Interest <br /> Code; and <br /> WHEREAS, pursuant to CGC Section 87302, the Conflict of Interest Code shall provide <br /> for specific enumeration of the positions within the Town, other than those specified in CGC <br /> 87200, which involve the making or participation in the making of decisions which may <br /> foreseeably have a material effect on any financial interest and for each such enumerated <br /> position, the specific types of investments, business position interests in real property and <br /> sources of income which must be reported by designated positions; and <br /> WHEREAS, the Town Council at this time wishes to rescind the Conflict of Interest Code <br /> adopted by Resolution 2012-18 and to adopt a revised Conflict of Interest Code which will <br /> designate employees required to comply with the Conflict of Interest Code; and to establish a <br /> clearly defined conflict policy; and <br /> WHEREAS, the Fair Political Practices Commission (FPPC) has adopted a regulation, <br /> Title 2, California Code of Regulations, Section 18730, which contains the terms of a standard <br /> model Conflict of Interest Code, which can be incorporated by reference, and which may be <br /> amended by the FPPC to conform to amendments in the Political Reform Act; and <br /> WHEREAS, incorporation by reference of the terms of the aforementioned regulation <br /> and amendments thereto in the Town's Conflict of Interest Code will save the Town time and <br /> money by minimizing the actions required of that body to keep its Code in conformity with the <br /> Political Reform Act. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE TRUCKEE TOWN COUNCIL THAT: <br /> Section 1. Resolution 2014-28, adopted June 10, 2016 is hereby rescinded. <br /> Section 2. The terms of Title 2 California Code of Regulations, Section 18730 and any <br /> and all amendments to it adopted by the Fair Political Practices Commission are hereby <br /> incorporated by reference, as well as the attached Appendices A & B in which officials and <br /> employees are designated and disclosure categories are set forth, and constitute the Conflict of <br /> Interest Code of the Town of Truckee. <br /> 111Section 3. Designated employees shall file Statements of Economic Interests with the <br /> Town Clerk, to whom the Town Council hereby designates the authority to carry out the duties <br /> of the Filing Officer. <br />
