TOWN OF TRUCKEE <br /> California <br /> ORDINANCE 2015-10 <br /> AN ORDINANCE REPEALING CHAPTER 9.14 OF THE <br /> TRUCKEE MUNICIPAL CODE REGARDING OPEN CONTAINERS OF ALCOHOL <br /> AND RE-ENACTING CHAPTER 9.14 REGARDING CAMPING <br /> WHEREAS, the Truckee Police Department has received numerous complaints about <br /> people camping on public or private property without the permission of the property owner or the <br /> owner's agent, and has encountered a number of people engaged in such camping; and <br /> WHEREAS, the Town of Truckee does not currently have in place any ordinance <br /> prohibiting unauthorized camping on public or private land; and <br /> WHEREAS, prohibiting unauthorized camping would provide another enforcement <br /> option to deal with this issue, one that is less severe than an arrest and criminal citation for <br /> trespassing; and <br /> WHEREAS, current Chapter 9.14 of the Truckee Municipal Code regarding open <br /> containers of alcohol has been duplicated and effectively superseded by Chapter 9.18, and <br /> there is no benefit to retaining Chapter 9.14 in its current form as part of the Municipal Code; <br /> The Town Council of the Town of Truckee Does Ordain as Follows: <br /> Section 1. <br /> Chapter 9.14 of the Truckee Municipal Code is hereby repealed in its entirety, <br /> and re-enacted to read as set forth in Exhibit "A", attached hereto and incorporated herein by <br /> reference. <br /> Section 2. <br /> If any section, subsection, sentence, clause or phrase of this ordinance is for any <br /> reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision <br /> shall not affect the validity of the remaining portions of the ordinance. The Town Council of the <br /> Town of Truckee hereby declares that it would have passed this ordinance and each section, <br /> subsection, sentence, clause and phrase thereof irrespective of the fact that one or more <br /> sections, subsections, sentences, clauses or phrases may be held invalid or unconstitutional. <br /> Section 3. <br /> The Town Clerk is hereby directed to publish this ordinance in accordance with <br /> the law. <br /> 1 <br />
