Town of Truckee <br /> California <br /> <br /> RESOLUTION NO. 2003-10 <br /> <br /> A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br /> APPROVING THE APPEAL OF APPLICATION NO. 02-075/HDR/UP <br /> <br /> WHEREAS, Dennis E. Zirbel Architect submitted an application requesting approval <br />of a certificate of appropriateness and use permit to construct two office buildings for Hunt <br />Mountain Homes and Lake Tahoe Mortgage respectively; and <br /> <br /> WHEREAS, the Town of Truckee Planning Commission, as the authorized review <br />body for use permits and at a duly noticed public hearing, denied the certificate of <br />appropriateness and use permit by failing to pass a motion approving the certificate of <br />appropriateness and use permit; and <br /> <br /> WHEREAS, Dennis E. Zirbel submitted an appeal of the Commission's decision to <br />deny the certificate of appropriateness and use permit; and <br /> <br /> WHEREAS, the Town Council is responsible for considering appeals of Planning <br />Commission decisions and considered the appeal at a duly noticed public hearing; and <br /> <br /> WHEREAS, the Town Council received testimony on the appeal from the appellant; <br />applicant and all other persons wishing to provide testimony and considered such <br />testimony in their decision. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN <br />OF TRUCKEE as follows: <br /> <br /> 1. The Council hereby approves the appeal of Dennis E. Zirbel; <br /> 2. Affirms the finding that the project is exempt from further environmental <br /> review pursuant to Section 15332 of the California Environmental Quality <br /> Act Guidelines; <br /> 3. Approves the use permit for the office and financial services uses and <br /> development on slopes greater than 20%, subject to the conditions of <br /> approval set forth in Exhibit A (Conditions of Approval) attached hereto <br /> and incorporated herein. <br /> 4. Approves the certificate of appropriateness for historic design review, <br /> subject to the conditions of approval set forth in Exhibit A (Conditions of <br /> Approval) attached hereto and incorporated herein. <br /> 5. Approves the use permit for 21 on-street parking spaces to be counted <br /> towards off-street parking requirements subject to the conditions set forth <br /> in Exhibit "A" of this resolution. <br /> <br /> <br />
