Town of Truckee <br /> California <br /> <br /> RESOLUTION NO. 2003-02 <br /> <br /> A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE FOR A <br /> PARTIAL DRAINAGE AND PARTIAL MULTIPURPOSE EASEMENT <br /> ABANDONMENT ON <br /> ASSESOR'S PARCEL NUMBER 17-120-73 <br /> (TERENCE STREET) <br /> <br /> WHEREAS, the Town of Truckee has received an application requesting the <br />abandonment of those portions of an existing 25-foot Drainage Easement and 20-foot <br />Multipurpose Easement into which a single-family building, including porte cochiere, <br />second-story decks, eaves, and stairs encroaches within Lot 39 of Donner Lake Woods <br />Phase 2, as per map filed for record September 30, 1992 in Book 8 of Subdivisions, at <br />page 7, in the Recorders Office of Nevada County, California, located in Section 15, <br />Township 17 North, Range 15 East, MD,M; and <br /> <br /> WHEREAS, environmental review has been conducted in accordance with the <br />California Environmental Quality Act (CEQA) and the CEQA Guidelines and the Town <br />Council has determined the project will not have a significant impact on the environment <br />and is exempt from environmental review in accordance with Section 15303(a) of the <br />CEQA Guidelines; and <br /> <br /> WHEREAS, the Community Development Director, Town Engineer and Public <br />Works Director have reviewed the partial Drainage Easement abandonment and find the <br />portion of easement in question has not been used for the purpose for which it was <br />dedicated or acquired for five consecutive years immediately preceding the requested <br />vacation, and the easement is not necessary for present or prospective use; and <br /> <br /> WHEREAS, the Community Development Director, Town Engineer and Public <br />Works Director have reviewed the partial Multipurpose Easement abandonment and find <br />the easement will be superceded by relocation upon compliance with the conditions of <br />approval; and <br /> <br /> WHEREAS, there are no in-place public utility facilities located in the portion of <br />Drainage Easement or Multipurpose Easement to be abandoned that are in use or would <br />be affected by the abandonment and the Town has not received any objections to the <br />proposed Drainage Easement or Multipurpose Easement abandonment from any public <br />utility or special district; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE TOWN CQLINClL OF THE <br />TOWN OF TRUCKEE that the Town Council hereby abandons those portions of the <br />Drainage Easement and Multipurpose Easement into which the single-family building, <br /> <br /> <br />
