TOWN OF TRUCKEE <br /> California <br /> <br />RESOLUTION NO. 2002-58 <br /> <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br />OPPOSING MEASURE D, THE PROPERTY CLAIMS REIMBURSEMENT PROCESS <br />INITIATIVE <br /> <br /> WHEREAS, the voters of the Town of Truckee will vote on Measure D at the <br />November 2002 election; and <br /> <br /> WHEREAS, Measure D may have an impact on the planning and land use <br />regulations applied to property adjacent to and near the Town of Truckee which could <br />negatively impact the Town and its residents and property owners, and <br /> <br /> WHEREAS, in the course of fully informing themselves concerning Measure D, <br />the voters should be aware of the position(s) of their locally elected officials; and <br /> <br /> WHEREAS, on September 19, 2002 the Town Council conducted a public <br />discussion on Measure D and heard the views of all speakers both in favor and <br />opposed to Measure D; and <br /> <br /> WHEREAS, after deliberation and discussion the Town Council has decided to <br />take a position with regard to Measure D; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE <br />TOWN OF TRUCKEE finds that: <br /> <br /> 1. The proposed Measure D contains ambiguous language such that it is not <br />possible to determine its potential effect on adopted planning policies and land use <br />regulations or the potential fiscal impact of implementing the measure. <br /> <br /> 2. Current law contains procedures, checks and balances designed to safeguard <br />property rights. <br /> <br />In recognition of the foregoing findings, the Town Council hereby expresses its <br />opposition to Measure D and encourages the voters to fully inform themselves prior to <br />casting their ballot. <br /> <br /> The foregoing Resolution was introduced at a Regular Meeting of the Truckee <br />Town Council, held on the 17th day of October, 2002 and adopted by the following vote: <br /> <br /> AYES:Councilmembers Susman, Owens, McCormack, and Mayor Florian. <br /> NOES: Councilmember Schneider. <br /> ABSENT:None ~~~' .~,~ , <br /> · Ronald J.
