Town of Truckee <br />California <br /> <br />RESOLUTION NO. 2002-47 <br /> <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE FOR A <br />PARTIAL ABANDONMMENT OF A PUBLIC UTILITY EASEMENT ON 12237 LEMON <br />COURT PARCEL NUMBER 16-400-18 <br />(MICHAEL RODARTE) <br /> <br /> WHEREAS, the Town of Truckee has received an application requesting approval <br />of a partial Public Utility Easement abandonment, five feet wide, lying along the westerly <br />most portion of the existing fifteen foot Public Utility Easement along the East property line <br />of Lot 255, of Prosser Lakeview Estates Unit No. 3, per Bk. 3 of Subdivisions, pg 19, in the <br />Recorders Office of Nevada County, California, located in Section 35, Township 18 North, <br />Range 16 East, M.D.B. & M., subject to the following condition being met by the <br />applicant/owner Michael Rodarte requesting the abandonment: and <br /> <br /> WHEREAS, environmental review has been conducted in accordance with the <br />California Environmental Quality Act (CEQA) and the CEQA Guidelines and the Town <br />Council has determined the project will not have a significant impact on the environment <br />and is exempt from environmental review in accordance with Section 15061(b)(3) of the <br />CEQA Guidelines; and <br /> <br /> WHEREAS, the Community Development Director, Town Engineer and Public <br />Works Director have reviewed the proposed abandonment and find the easement is no <br />longer necessary for public purposes; and <br /> <br /> WHEREAS, there are no public utility facilities located in the easement to be <br />abandoned and the Town has not received any objections to the proposed partial <br />abandonment from any public utility or special district; and <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE <br />TOWN OF TRUCKEE that the Town adopts this resolution to abandon any and all interest <br />to the five foot wide strip of the public utility easement, lying along the westerly most <br />portion of the existing fifteen foot Public Utility Easement along the East property line of <br />Lot 255, of Prosser Lakeview Estates Unit No. 3 per Bk. 3 of Subdivisions, pg. 19, in the <br />Recorders Office of Nevada County, California, located in Section 35, Township 18 North, <br />Range 16 East, MD.B. & M., subject to the following conditions being met by the <br />applicant/owner Michael Rodarte requesting the abandonment: <br /> <br />1. A lO-foot public utility easement shall be maintained along the eastern property <br /> line. <br />2. A six-inch sanitary sewer main pipeline shall be installed along the entire rear of the <br /> parcel 10-feet away from the eastern property line prior to recordation of the <br /> easement abandonment. <br /> <br /> <br />
