TOWN OF TRUCKEE <br />California <br /> <br />RESOLUTION <br />NO. 2002-28 <br /> <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE FOR <br /> DENYING THE APPEAL OF APPLICATION NO. 02-009/TM <br /> <br /> WHEREAS, the Redbank Properties LLC. Submitted an application requesting <br />approval of a tentative map to create one single-family residential lot with a parcel size <br />of 5.88 acres and a remainder of 70.29 acres; and <br /> <br /> WHEREAS, the Town of Truckee Zoning Administrator, as the authorized review <br />body for a tentative map and at a duly noticed public hearing, approved Application No. <br />02-009 with conditions on May 8, 2002; and <br /> <br /> WHEREAS, Rick Bagnall, Kristi Bagnall, and Linda Lareau submitted an appeal <br />of the Zoning Administrator's decision to approve the tentative map with conditions; and <br /> <br /> WHEREAS, the Town Council is responsible for considering appeals for Zoning <br />Administrator decisions and considered the appeal at a duly noticed public hearing; and <br /> <br /> WHEREAS, the Town Council received testimony on the appeal from the <br />appellant, applicant, and all other persons wishing to provide testimony and considered <br />such testimony in their decision. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE <br />TOWN OF TRUCKEE as follows: <br /> <br />The Council hereby denies the appeal of Rick Bagnall, Kristi Bagnall, and <br />Linda Lareau; <br /> <br /> 2. The Council hereby affirms the decision of the Zoning Administrator <br />finding the project categorically exempt from the California Environmental Quality Act <br />and approving the tentative map with conditions. <br /> <br /> BE IT FURTHER RESOLVED, the Town Council adopts the findings set forth in <br />the April 10, 2002 Zoning Administrator staff report in support of the Council's actions to <br />deny the appeal and affirm the decision of the Zoning Administrator. Further, the <br />Council accepts the evidence and information provided in the Town Council Staff Report <br />prepared for the appeal hearing as further support of these actions. <br /> <br /> <br />
