JfHON OF THE TOWN COUNCIL OF THE TOWN <br />OF TRUCKEE APPROVING A SUMMARY VACATION OF A <br />PORTION OF A TEMPORARY CUL-DE-SAC EASEMENT AT <br />THE NOffIH END OF ASPEN~OOD ROAD 1N THE <br />PONDEROSA PALISADES UN1T NO. 4. <br /> <br />W[tEREAS, the Town of Truckee has received a request to vacate and abandon ten feet of the <br />west side of the temporary cul-de-sac easement at the north end of Aspenwood Road in the <br />Ponderosa Palisades Unit No. 4; and <br /> <br />WHEREAS, the Directors of Public Works and Community Development have reviewed the <br />proposed vacation and fred the easements no longer necessary for public purposes; and <br /> <br />WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code, Section 8335, <br />et seq., provides a proeedure for summary vacation of street easements; and <br /> <br />WHEREAS, there is a fmding that this portion of the temporary cul-de-sac easement has not <br />been developed for road purposes and that property improvement has inadvertently been placed <br />on this portion of the easement; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN <br />OF TRUCKEF, as follows: <br /> <br />Summarily vacates and abandons the west ten feet of the western side of the <br />temporary cul-de-sac easement within lot 143 of the Ponderosa Palisades Unit No. <br />4 as shown on Exhibit A; <br /> <br />Declares that from and after the date that this Resolution is recorded the subject <br />easement no longer constitutes public easements; and <br /> <br />Instructs the Town Clerk to record this Resolution of Vacation of Public <br />Easement, pursuant to Section 8336 of the Streets and Highways Code. <br /> <br />The foregoing Resolution was introduced at a Regular Meeting of the Town Council of the Town <br />of Truckee, held on the 2nd day of June, 1994, by Council Member Aguera who moved its <br />adoption, which motion being duly seconded by Council Member Cross was upon roll call carded <br />and the Resolution adopted by the following vote: <br /> <br /> <br />
