CALL TO ORDER - Mayor Brown called the meeting to order at 6:00 p.m. 2. ROLL CALL: Council Members; Green, Anderson, deRyk-Jones, Vice Mayor Dee, and Mayor Brown. Staff Present: David Griffith, Redevelopment and Housing Coordinator; Denyelle Nishimori, Associate Planner; Duane Hall, Town Planner; Kim Szczurek, Administrative Services Director; Nicholas Sensley, Chief of Police; Todd Landry, Senior Engineer; Denyelle Nishimori, Associate Planner; Diane McLaughlin, Administrative Services Manager; Dennis Crabb, Town Attorney; Alex Terrazas, Assistant to the Town Manager; and Judy Price, Town Clerk. 3. PLEDGE OF ALLEGIANCE - Led by Juanita Schneider. 6:01 :22 PM PUBLIC COMMENT 4. Dean Schaecher announced his appointment to Truckee Downtown Merchants Association (TDMA) President. Mr. Schaecher is involved in the Main Street Program and is looking forward to working with the Town. 5. PRESENTATIONS - None. 6. 602:31 PM CONSENT CALENDAR Council Member Joan de-Ryk-Jones pulled Item 6.2 for further discussion. Council Member Green pulled Item 6.8 for further discussion. Juanita Schneider pulled Item 6.6 for further discussion. It was moved by Council Member Green seconded by Council Member Joan de-Ryk- Jones to approve Items 6.1, 6.3, 6.4, 6.5, and 6.7 as follows: 6.1 Approve the Minutes of January 15, and 20, 2009. Council Member Anderson abstained due to his absence from the January 15, 2008 meeting. Adopt Resolution 2009-07 for the adoption of the California Public Employee's. Deferred Compensation Plan; and authorize the Town Manager to execute the Employer Adoption Agreement. Approve Resolution 2009-06 adopting certain modification to the Town of Truckee's Personnel Rules, including the Employer-Employee Relations pursuant to the Meyers- Milias Brown Act. 6.3 6.4 Town of Truckee February 5, 2009 Regular Page 1 6.5 Adopt Resolution 2009-08 authorizing the Town Manager to submit a funding proposal to receive the Town's appropriated funds from the State-Local Partnership Program. Authorize purchases from Cop Shop Install (CSI) not to exceed $45,000. I 6.7 6.2 Support for the Town of Truckee Hosting Events of the 2010 Western States Police and Fire Games. Recommended Action: Adopt Resolution 2009-09 supporting the hosting of events for the Western States Police and Fire Games in 2010. Council Direction: . Staff will direct the event organizers to work with the Donner Lake Homeowners to minimize the impact of the event on the neighborhood. The staff recommendation, including the direction provided above, was moved by Council Member Anderson, seconded by Council Member deRyk-Jones, with the following vote: 6:07:01 PM Ayes: Council Member Anderson, Mayor Brown, Vice Mayor Dee, Council Member Green and Council Member deRyk-Jones. Noes: None. Absent: None. Abstain: None. The motion passed unanimously. 6.8 Adoption of Workforce Housing Ordinance 2008-09. continued item from January 15, 2009. Recommended Action: Waive the second reading and adopt Ordinance 2008-09 amending Title 18 of the Municipal Code. I Council Member Green pulled the item in order to vote no and maintain consistency in voting for this item. The staff recommendation was moved by Council Member deRyk-Jones, seconded by Council Member Anderson, with the following vote: 6:0603 PM Ayes: Council Member Anderson, Mayor Brown and Council Member deRyk- Jones. Noes: Vice Mayor Dee and Council Member Green. Absent: None. Abstain: None. The motion passed 3-2. 6.6 Claim for Damages Against the Town of Truckee. Recommended Action: Reject the claim for damages of Lori Kelley, relating to the storm incident on January 4, 2008. , Juanita Schneider requested a brief description of the claim. The staff recommendation was moved by Vice Mayor Dee, seconded by Council Member deRyk-Jones, with the following vote: 6:07:29 PM Ayes: Council Member Anderson, Mayor Brown, Vice Mayor Dee, Council Member Green and Council Member deRyk-Jones. Noes: None. Absent: None. Abstain: None. The motion carried unanimously. 7. DISCUSSION ITEMS 6:07:52 PM 7.1 STAFF REPORT - Proposals for the Trout Creek Shed Outbuildings. Recommended Action: Consider the three proposals received for the Trout Creek shed outbuildings and select Truckee Development Associates' proposal allowing for demolition of the sheds with future reuse to be determined. Denyelle Nishimori, Associate Planner, presented from the staff report. Council Discussion: . What happens with the buildings if the Railyard doesn't move forward? . Truckee Development Associates will incur expenses to store the material, any additional restrictions will be to onerous. Mayor Brown opened the item for public comment. Seeing none, Mayor Brown closed public comment. 6: 13:00 PM The staff recommendation was moved by Council Member Green, seconded by Vice Mayor Dee, with the following vote: 6:16:11 PM Ayes: Council Member Anderson, Mayor Brown, Vice Mayor Dee, Council Member Green and Council Member deRyk-Jones. The motion passed unanimously. 7.2 PUBLIC HEARING - Continued Public Hearing to accept a Downtown Truckee Parking Structure Feasibility Study, Capital Improvement Program (CIPI 60-08-09. Recommended 'Action: Continue the public hearing and adopted Resolution 2009-10 accepting the revised Downtown Truckee Parking Structure Feasibility Study funded by the Planning/Technical Assistance Grant from the State Community Development Block Grant (CDBG) Program. I 6:24:07 PM Council Discussion: o Loss of community character based on the loss of residential space to retail space. o This study does not show a need for a garage now or in the future. Mayor Brown opened the Public Hearing asking for anyone wishing to speak in support or opposition to accepting the revised Downtown Truckee Parking Structure Feasibility Study. Seeing none, Mayor Brown closed the public hearing. The staff recommendation was moved by Council Member Anderson, seconded by Vice Mayor Dee, with the following vote: 6:2556 PM Ayes: Council Member Anderson, Mayor Brown, Vice Mayor Dee, Council Member Green and Council Member deRyk-Jones. Noes: None. Absent: None. Abstain: None. The motion passed unanimously. 7.3 STAFF REPORT - Upper Mciver Dairy Site -Initiation of Amendment to Town Zoning Map. Recommended Action: Adopt Resolution 2009-03 initiating an amendment to the Town Zoning Map for the property known as the Upper Mciver Dairy site (Assessor's Parcel Number 19-460-07). I Duane Hall, Town Planner, presented from the staff report. Council Discussion: o The process will conclude in May. o The zoning allows for 105 unit potential. o Constraints will affect the development potential. o If the Town wants credit for the sight the re-zoning will need to be complete by June. o The access easement is through a parking lot for the medical office adjacent to the easement. Mayor Brown opened the item for public comment. Juanita Schneider, Truckee resident, spoke in opposition to housing on this site expressing concerns regarding traffic on Donner Pass Road in this vicinity, and the addition of housing close to the government center. Mayor Brown closed public comment. I Council Discussion: Town of Truckee February 5, 2009 Regular Page 4 I I I 8. o Considering re-zoning to the highest use numbers. o The zoning categories establish a maximum. o Expectations may be established based on the zoning. o At the end of the public review. process the density may be modified. o The M-15 is the maximum staff will exam for the site. o The site represents in-fill, is in close proximity to transportation and services making it an appropriate site for affordable housing. o Smart growth principles apply to the site. o Density is a valid concern. Dissenting opinion: o The site is not appropriate for the zoning designation proposed for study. o The site is uphill from a wetland, access is difficult, will require tree loss, may cause historic value degradation, and traffic is difficult. The staff recommendation was moved by Council Member deRyk-Jones, seconded by Mayor Brown, with the following vote: 6:46:22 PM Ayes: Council Member Anderson, Mayor Brown, Vice Mayor Dee and Council Member deRyk-Jones. Noes: Council Member Green Absent: None Abstain: None The motion carried 4-1. 6:46:45 PM COUNCIL REPORTS Vice Mayor Dee o Attended Nevada County Transportation Commission (NCTC). o Discussed the Federal stimulus package. o Was appointed to Vice Chair. o Announced former Council Member Susman was appointed to Chair of the Transportation Services Commission. Council Member Jones o Attended Housing Element Update workshop: o Initial stages of the update. o Program lightly attended. o Encouraged others to attend. 9.1 9. CLOSED SESSION 9.2 CONFERENCE WITH LABOR NEGOTIATORS - General Employees Association, Mid- Managers Association, and Police Officers Association. Negotiators: Alex Terrazas and Kim Szczurek, Government Code Section 54957.6(1). No reportable action. CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION - One Case, Government Code Section 54956.9 (b) Town of Truckee February 5, 2009 Regular Page 5 9.3 Reportable action: Council directed Staff to pursue litigation if a code compliance agreement is not executed by February 9, 2009 CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION - Pending litigation T own of Truckee v. Stratton, Karen High v. Town of Truckee, and Sheila and Chuck Reever v. Town of Truckee, Government Code Section 54956.9 (a). No reportable action. PUBLIC EMPLOYEE PERFORMANCE EVALUATION - Town Attorney, Government Code Section 54957 (e). Reportable action: The Town Attorney was directed to prepare a professional services agreement for his services for consideration at the next Truckee Town Council meeting. 9.4 10.
