15 Highway 267 Phasing PolicyTOWN OF TRUCKEE California RESOLUTION No. 98-15 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE ESTABLISHING PROCEDURES FOR THE PROCESSING OF LAND USE DEVELOPMENT APPLICATIONS ALONG THE HIGHWAY 267 CORRIDOR WHEREAS, Land Use Policy 3.5 of the General Plan prohibits new discretionary development along the Highway 267 corridor that would result in a net increase in traffic at Highway 267 and Commercial Row until the Highway 267 Bypass or other major transportation improvements are in place; and WHEREAS, the factors and the assumptions based on those factors that led to the implementation of Land Use Policy 3.5 have changed substantially since the adoption of the General Plan in February 1996, including significant improvement in public transportation; and WHEREAS, the Western Undererossing and Highway 267/Palisades Drive traffic signalization projects should be completed by October 1998, and these projects will substantially improve traffic in the Downtown area to acceptable levels; and WHEREAS, the Highway 267 Bypass is fully funded and scheduled for construction in May 1999 and completion in October 2001; and WHEREAS, the Council wishes to eliminate restrictions imposed by Land Use Policy 3.5 on the processing of land use development applications and the issuance of construction permits for properties along the Highway 267 corridor, thereby allowing development to occur once the Western Undercrossing is completed and construction of the Highway 267 Bypass is underway. NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TRUCKEE, AS FOLLOWS: 1. The Town Council hereby finds that the Western Undercrossing and the signalization of the Highway 267/Palisades Drive are alternative major transportation improvements as described in Land Use Policy 3.5. 2. The Community Development Department may accept discretionary land use development applications along the Highway 267 corridor, and these applications may be considered and approved in accordance with the Town Zoning Ordinance and Subdivision Ordinance. 3. Discretionary land use development applications that would result in a net increase in traffic at Highway 267 and Commercial Row shall be subject to the following condition: "No grading or building permits shall be issued until the Western Undercrossing and Highway 267/Palisades Drive signalization projects are completed and construction for the Highway 267 Bypass has commenced as determined by the Community Development Director." Construction commencement for the Bypass shall be the initiation of Town of Truckee Resolution 98-~_ Page 2 earthwork or structural improvements for the road alignment and/or bridge and does not include acquisition of right-of-way or the relocation of utilities. The foregoing Resolution was introduced at a Regular Meeting of the Town Council of the Town of Truckee, held on the 7th day of May, 1998, by Councilmember Drake who moved it's adoption, which motion duly seconded by Councilmember Schneider was upon roll call carded and the Resolution adopted by the following vote: AYES: Councilmembers Drake, McCormack, Schneider, Susman & Mayor Florian NOES: None ABSENT: None Ronald Florian, Mayor ATFEST: Stephen'L.XeWright, Town"C~erk
