<br />I <br /> <br />TOWN OF TRUCKEE <br />California <br /> <br />RESOLUTION 2008~67 <br /> <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE APPROVING AN <br />APPLICATION FOR GRANT FUNDS FOR THE 2009/2010 BICYCLE TRANSPORTATION <br />ACCOUNT (BTA) FOR THE TRUCKEE RIVER LEGACY TRAIL PHASE 3 <br /> <br />WHEREAS, the Streets and Highways Code, Bicycle Transportation Account provides <br />funds for grants to local agencies for projects that improve safety and convenience for bicycle <br />commuters; and <br /> <br />WHEREAS, the State of California, Bicycle Facilities Unit, has the responsibility for the <br />project administration of the program with the State, setting up necessary procedures governing <br />project applications under the program; and ' . <br /> <br />WHEREAS, the Town of Truckee proposes to complete an important segment of the <br />Truckee River Legacy Traii that is included in the Truckee Trails and Bikeway,Master Plan;'and <br /> <br />WHEREAS, the Town of Truckee, if selected, will enter into an agreement with the State <br />of California to complete the project, and <br /> <br />I <br /> <br />WHEREAS, based upon the revenue projections for the 2009/2010 and 2010/2011 fiscal <br />years, the Town of Truckee will have sufficient funds for the $200,000 matching funds, which <br />will be programmed in the 2009/2010 and 2010/2011 Fiscal Year Truckee River Legacy Trail <br />Phase 3 Capital Improvement Program; and <br /> <br />WHEREAS, all contracts relating to the application for the State Bicycle Transportation <br />Account Grant Funds shall be approved by the Town Attorney. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF <br />TRUCKEE AS FOLLOWS: <br /> <br /> 1. <br /> 2. <br /> 3. <br /> 4. <br /> 5. <br /> 6. <br />I 7. <br /> <br />Approves the filing of an Bicycle Transportation Account application for the <br />Truckee River Legacy Trail Phase 3. <br />Certifies that the Town understands the assurances and certification in the <br />application. <br />Certifies that Town will have sufficient funds to operate and maintain the project <br />consistent with the land tenure requirements. <br />Certifies that it will comply with all provisions of Section 1771.5 of the California <br />Labor Code. <br />Authorizes the Town Manager, or his designee, to execute and submit the <br />application, agreement and amendments as required. <br />Authorizes the Town Engineer, or his designee, to conduct all negotiations, to <br />execute and submit all payments requests, required reports and other <br />documentation as may be necessary for the completion of the aforementioned <br />project. <br />Approves the use of $200,000 for the grant matching requirement. <br />
