Covid-19 virus emergency declarationAGENDA ITEM 5.1 TOWN OF CYNA-FrIf MEETING DATE: March 10, 2020 TO: Honorable Mayor and Council Members FROM: Jeff Loux, Town Manager Andrew Morris, Town Attorney SUBJECT: Declaration of local emergency re COVID-19 virus APPROVED BY Jeff Loux, Town Wnaqer RECOMMENDATION: That the Town Council adopt Resolution 2020-16 declaring a local emergency regarding the COVID-19 virus and authorizing the Town Manager to request assistance from the State of California if necessary. DISCUSSION: The COVID-19 virus is currently spreading in California and the United States. There are currently no known or suspected cases in Truckee or elsewhere in Nevada County. However, the Nevada County Office of Emergency Services has declared a local emergency for Nevada County, and we understand that Grass Valley and Nevada City are likely to follow suit. The Town Manager and Town Attorney have determined that a declaration of local emergency by the Town Council may help the Town obtain state or federal disaster funds if the Town ends up having to make expenditures related to COVID-19. Under Chapter 2.50 of the Truckee Municipal Code, a declaration of local emergency also positions the Town to act very quickly in taking steps to prevent or contain a COVID-19 outbreak, and it seems prudent for the Town to be prepared. It is worth reiterating that this declaration of emergency is proactive in nature. There is no reason for Truckee residents or visitors to panic. The Town's emergency operations staff remain in close contact with their Nevada County counterparts, Nevada County Public Health, Truckee Fire, and Tahoe Forest Hospital to coordinate efforts and engage in planning and forecasting. The Town will continue these preparation and planning efforts, alongside our partner agencies. FISCAL IMPACT: The declaration of emergency will not incur any costs for the Town, and may help the Town receive disaster funding in the event that the Town has to expend funds on dealing with COVID-19 and related issues. ATTACHMENTS: Resolution 2020-16 Page 1 of 1 TOWN OF TRUCKEE California RESOLUTION 2020-16 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE DECLARING A LOCAL EMERGENCY AND REQUEST FOR ASSISTANCE UNDER THE CALIFORNIA DISASTER ASSISTANCE ACT WHEREAS, Town of Truckee Municipal Code Chapter 2.50 provides for the preparation and carrying out of plans for the protection of persons and property within the Town in the event of emergency or disaster; and WHEREAS, Chapter 2.50 authorizes the Town Council to declare the existence of a local emergency, comprising the existence of conditions of disaster or extreme peril to the safety of persons and property within the Town of Truckee, and upon such declaration activates the Town disaster corps and designates the Town Manager as the Town's disaster manager; and WHEREAS, conditions of extreme peril to the safety of persons or property have arisen within the Town of Truckee as a result of the spread of the COVID-19 virus throughout the State of California including a death due to the virus in neighboring Placer County on Wednesday, March 4; and WHEREAS, the Governor of California declared a Statewide state of emergency due to the COVID-19 virus on Wednesday, March 4; and WHEREAS, the Town Council does hereby find the aforesaid conditions of extreme peril did warrant and necessitate the proclamation of the existence of a local emergency in the Town of Truckee; and WHEREAS, the Town Council does hereby find that local resources are unable to cope with the effects of said emergency; and NOW THEREFORE BE IT RESOLVED that the Town Council hereby declares a local emergency due to the existence or threatened existence of conditions of disaster or of extreme peril to the safety of persons and property within the Town of Truckee; and IT IS FURTHER RESOLVED AND ORDERED that the local emergency shall be deemed to continue to exist until its termination is proclaimed by the Town Council of the Town of Truckee; and IT IS FURTHER RESOLVED AND ORDERED that during the existence of said local emergency the powers, functions and duties of the Town of Truckee and its Town Manager serving as disaster director shall be those prescribed by state law, and by the charter, ordinance and resolutions of this Town; and IT IS FURTHER RESOLVED AND ORDERED that the Town Manager, serving as disaster director, shall request assistance from the State of California pursuant to the California Disaster Assistance Act, if he or his designee determines that doing so is necessary or beneficial to the Town of Truckee; and IT IS FURTHER ORDERED that a copy of this Resolution be forwarded to the State Director of the Office of Emergency Services; and IT IS FURTHER ORDERED that Robert Womack, Emergency Services Coordinator of the Town of Truckee, is hereby designated as the authorized representative of the Town of Truckee for the purpose of receipt, processing, and coordination of all inquiries and requirements necessary to obtain available State and Federal assistance.
