02 Zoning Change 18-500-52Town of Truckee California ORDINANCE NO. 94-2 AN ORDINANCE OF THE TOWN OF TRUCKEE APPROVING ZONE CHANGE FROM RI SINGLE FAMILY RESIDENTIAL TO C2-PD-D COMMUNITY COMMERCIAL WITH PLANNED DEVELOPMENT AND DESIGN DISTRICT OVERLAYS FOR 7.2 ACRES, ASSESSOR'S PARCEL NUMBER 18-500-52 The Town Council of the Town of Truckee Ordains as Follows: Section 1. That it hereby adopts the required findings and recommendation of the Town of Truckee Planning Commission regarding the subject property as contained in the Planning Commission's Resolution 93-008, attached hereto as Exhibit "A" and incorporated herein by reference.. Section 2. That it hereby approves the zone change from RI Single Family Residential to C2-PD-D Community Commercial with Planned Development and Design District Overlays for 7.2 acres, Assessor's Parcel Number 18-500-52. Ordinance 94-02 Page 2 The foregoing Ordinance was introduced at a regular meeting of the Town Council of the Town of Truckee, held on the 16th day of December, 1993, by Council Member Cross, who moved its introduction, which motion was seconded by Council Member Botto, was upon roll call carried by the following vote: AYES: Council Members Aguera, Botto, Carpenter, Cross & Mayor Eagan NOES: None ABSENT: None Kathleen Eagan, Mayor Stephen L. W~ight, Town The foregoing Ordinance, having been introduced on the 16th day of December, 1993, coming for final consideration by Council Member Aguera who moved its adoption the 6th day of January, 1994, which motion was duly seconded by Council Member Botto, was upon roll call carried by the following vote: AYES: Council Members Aguera, Botto, Carpenter, Cross & Mayor Eagan NOES: None ABSENT: None Kathleen Eagan, Mayor ATTEST: Stephen L. *~qright, Towh~r EXHIBIT "A" TO ORDINANCE 94-02 RESOLUTION NO. 93-008 "A RESOLUTION OF THE PLANNING COMMISSION OF THE TOWN OF TRUCKEE, CALIFORNIA RECOMMENDING THAT THE TOWN COUNCIL ADOPT AN ORDINANCE TO CHANGE THE ZONE FROM R-l, SINGLE-FAMILY RESIDENTIAL, TO C2-PD-D COMMUNITY COMMERCIAL, PLANNED DEVELOPMENT, DESIGN OVERLAY, ON THAT PROPERTY KNOWN AS A.P.N. 18-500-52." 'WHEREAS, the Planning Commission of the Town of Truckee at a regular meeting duly constituted on November 10, 1993, considered a request from Bill Deatsch and Bill Wl-dtehead to amend zoning upon a 4.2 acre parcel of land; and WI-IEREAS, the Planning Commission through Public Hearing considered the testimony of proponent% opponents and staff; and ¥/I![EREAS, the Planning Commission did review the environmental irlfot'mation related to the subject request; and NOW TI:I~.REFORE, the Planning Commission of the Town of Truckee DOES I-IFREI~Y RESOLVE as follows: SECTION 1. That the Town of Truckee Plnnning Commission recommends that the Town Council adopt an Ordinance to change the zoning on the described parcel as follows. From R-l, Single Family Residential, C2 (Community Commercial) PD (Planned Development) D (Design Overlay) and from C2-D to C2-PD-D. SECTION 2. That required findings by the Planning Commission of the Town of Truckee for approval of this Change of Zone are as follows: That there is reasonable probability that the proposed use will be consistent with the general plan proposal being considered or studied by the Town of Truckee or which will be studied within a reasonable time in that the C2-PD-D zonfng designation is more appropriate for the location, and will allow for a more well-designed project with greater controls for the location. That there is little or no probability of substantial detriment to or interference with the future-adopted general plan for the Town of Truckee if the proposed use is ultimately inconsistent with the Plan in that the commitment to a commercial use on the applicant's property should not interfere with neighboring property land use designations and is more logical for this comer property. Planning Commission Resolution No. 93-008 Page 2 The site proposed for zone change is not suitable for residential development in that the access limitation would require the residential user to access th.rough a commercial development. The proposed project will not detrimentally affect the adjoining residential properties or the financial health of the neighboring commercial and School District properties. The conditions placed on future projects can protect adjoining residential users from negative impacts of the future commercial project. Adequate public services are available in the area to serve the property. The site is suitable for most permitted uses allowed in the proposed zone. The environmentally sensitive area where the site is moderately sloped or greater will be set aside as open space to protect the sensitive balance of the property. That the conditions placed on the furore development of the property are necessary to the health, safety and welfare of the community. The designation of PD and D provides for design standards to be imposed for future applications and provides a process for review of any future projects. SECTION 3. The Planning Commission directs staff to forward a copy of this Resolution for Town Council consideration at future public hearings related to th[q matter.
