66 Abandonment Union MillsTOWN OF TRUCKEE California RESOLUTION NO. 2002-66 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE APPROVING THE SUMMARY VACATION AND ABANDONMENT OF A PORTION OF UNION MILLS ROAD RIGHT-OF-WAY AND PUE (APN 48-210- 09). WHEREAS, the Town of Truckee has received a request to abandon a portion of the Union Mills Road right-of-way and PUE located on APN 48-210-09 in order to facilitate the relocation of the State of California Department of Food and Agriculture Agricultural Inspection Station; and WHEREAS, environmental rex4cw has been conducted in accordance with the California Emdronmental Quality Act (CEQA) and the CEQA Guidelines and the Town Council has determined the project will not have a significant impact on the environment on the basis that an Initial Study/Mitigated Negative Declaration was certified by the State through State Clearinghouse Number SCH 99-082062; and WHEREAS, the CommuniD' Development Director and the Town Engineer/Director of Public Works have reviewed the proposed abandonment and find the easement abandonment is necessary for public purposes; and WHEREAS, Chapter 4 of Part 3 of Division 9 of the Street and Highway Code, Section 8335, et seq., provides a procedure for summary abandonment of easements; WHEREAS, the Town Council is able to achieve the finding of extraordina~ benefit of the realignment of Union Mills Road in coniunction with the relocation of the Agricultural Inspection Station and therefore waives all application and permit fees for abandonment of a portion of the Union Mills Road right-of-way and PUE; and NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TRUCKEE that the council hereby: 1. Approve the summary vacation and abandonment of a portion of Union Mills Road as described in exhibit "A" which is attached hereto and referenced herein. BE IT FURTHER RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF TRUCKEE, that the makes the following findings as outlined in Section 18.88.030, Findings for Vacations, of the Development Code: 1. The street will be superceded bv the relocation of the street and utilities; and 2. The relocation of the street will not cut off all access to a person's property, which prior to relocation, adjoined thc street. These findings are supported by the information pro,tided in the Town Council Staff Report dated December 19, 2002. The foregoing Resolution 2002-66 was introduced at a Regular Meeting of the Town Council of the Town of Truckee, held on the 19th day of December, 2002 and adopted by the following vote: AYES: Vice Mayor Susman, Councilmembers Florian and Ingalls, and Mayor Owens.
