TOWN OF TRUCKEE <br /> California <br /> <br />RESOLUTION NO. 2002-30 <br /> <br />A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TRUCKEE <br />ABANDONING PUBLIC ACCESS AND UTILITY EASEMENTS <br /> WITHIN APNs 19-430-141 151 161 17 <br /> <br /> WHEREAS, the Town of Truckee <br />abandonment of all public access and <br />14/15/16/17; and <br /> <br />has received an application requesting <br />utility easements within APNs 19-430- <br /> <br /> WHEREAS, said action requires legislative action by the Town Council, and the <br />Planning Commission, at a duly noticed public hearing, adopted Resolution No. 2002-13 <br />on May 29, 2002, thereby recommending approval of the abandonment; and <br /> <br /> WHEREAS, a public notice was published in the Sierra Sun and mailed to <br />property owners within 300 feet of the project site and all other interested persons <br />informing the public of the date, time, and location of the public hearing for the Council's <br />consideration of the abandonment; and <br /> <br /> WHEREAS, the Council held a public hearing on the matter at a regular meeting <br />on June 20, 2002 and considered all information and public comment related thereto. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE <br />TOWN OF TRUCKEE, the Council hereby abandons all public access and utility <br />easements located within the north half of Section 12, Township 17 East, Range 16 <br />East, M.D.B.M. lying north of Glenshire Drive. <br /> <br /> BE IT FURTHER RESOLVED, this action of the Council is based on the <br />following finding: <br /> <br />The applicant requests the abandonment of a 60'-wide public access and utility <br />easement that generally circles the properties. There are no streets or roads <br />constructed within these easements except a utility maintenance road <br />constructed along the eastern property line where a sewer main and water main <br />are installed. The applicant proposes to provide access to the southerly 315 <br />acres by street right-of-ways created by the first phase of the subdivision, which <br />will create open space, golf course, and development area parcels. An adjacent <br />property owner has objected to the abandonment; they wish to use the easement <br />adjacent to their property for access as part of a future subdivision. The property <br />owner currently does not have legal rights to use these easements, and the <br />property is legally accessed by Samuel Drive. The abandonment will not cut off <br /> <br /> <br />
