FOREST HIGHWAY AGREEMENT <br /> <br />Parties to Agreement: U.S. Department of Transportation, Federal Highway <br />Administration, Central Federal Lands Division, hereinafter called the "FHWA," <br />and City of Truckee, State of California, hereinafter called the "Cooperator." <br /> <br />Purpose: The purpose of this agreement is to set forth the general terms and <br />conditions, mutually acceptable to the parties hereto, for the project selection, <br />project agreements, survey, design, construction, rights-of-way acquisition, and <br />maintenance of Forest Highways in Truckee, California, pursuant to the provisions <br />of Title 23, United States Code (U.S.C.), Sections 116 and 204, and Title 23, <br />Code of Federal Regulations (C.F.R), Chapter 1: Subchapter G, Parts 625, 633, <br />(Subpart C), 645 (Subpart B), 650, (Subparts A, B and C), 652, 655 (Subpart E), <br />660 (Subpart A); and Subchapter H. <br /> <br />Forest Highway Routes: This agreement shall cover the Forest Highway <br />routes, previously approved for inclusion in the Forest Highway network, <br />which are listed and briefly described in Enclosure 1 and any approved <br />amendments thereof. The list of such approved routes may be varied from <br />time to time by mutual agreement between the Cooperator and FHWA either <br />by adding routes thereto or removing routes therefrom, or by altering the <br />description of any route to give it proper identity. Each such action shall be <br />indicated {1) by a revised list or (2) by a revised page, or pages, bearing the <br />signatures of the parties together with a showing of the effective date of the <br />revision. <br /> <br />Project Selection: Projects will be selected by mutual agreement of the <br />FHWA, the U.S. Department of Agriculture, Forest Service (FS), and the State <br />Highway agency (SHA), acting on behalf of the Cooperator, in accordance <br />with Title 23, C.F.R., Part 660.109. <br /> <br />Project Agreement: In addition to this Forest Highway Agreement, a project <br />agreement may be entered into between the FHWA and the Cooperator prior <br />to the expendltdre of Federal funds. The purpose of the project agreement will <br />be to spell out the project details not covered in this general agreement. <br />Additionally, the project agreement will set forth the procedures between the <br />FHWA and the Cooperator when: <br /> <br />(A) <br /> <br />The survey, construction, acquisition of rights-of-way, or maintenance <br />in connection with a project included in an approved Forest Highway <br />program is to be accomplished in a different manner from that set forth <br />in this Forest Highway Agreement; <br /> <br /> <br />
